Both. First you need to be with your kids. The women does NOT just get to keep them by default. You ideally do not want to move out of the house until a court approved parenting plan is in place. From the courts pov it can be seen as abandonment. 'There is nothing as permanent as a temporary order.'

The courts tend to heavily lean towards maintaining the status quo. So if she's agreeable make plans to either stay together or work out a plan for the kids to be 50/50 now during the divorce.

You either have an 'agreement' with the STBX (privately, but ideally court approved) or you risk access yo the kids down the line. You have have 50/50 custody but still end up with her having primary residency. Ie every other weekend for you.

Once the divorce is finalized there will 100% be a 'permanent' custody, residency and child support agreement in place.
