This is a follow up to another post I made sharing my sob story. I got lots of feedback telling me not to move out of the home even though my wife is actively on the dating apps and asking me to babysit while she's out cavorting with other men (I have been refusing and she has been paying for sitters).

As long as I stay in the home, I am unable to move on, and continue to be traumatized by her behavior. However, if I move out now, I'm paying for all my new living expenses (rent, furniture, etc.) plus still paying the mortgage and all her expenses through our joint checking account. She does not work and is relying on the 50/50 split of assets and eventual child support to keep her afloat.

Since she can't buy out my equity, I think I can force the sale of the home. However, I've been informed by a lawyer that submitting temporary orders, and actually getting them through the court system, could be 2-3 months depending on the judge's docket. Right now, we are pursuing mediation over litigation, and I'm torn over whether it's best to let that proceed or hire a lawyer and start forcing this process along. In the long run, I just want it to be over, and I'm concerned going the litigation route will create disagreements and further strife that will only extend the process through motions and continuances.

So here I remain. In the family home with my cold, distant, and openly dating soon-to-be-ex while I wait for this mediation process to unfold over the coming weeks and months. I don't want to move out and let her win and keep her comfortable life. Before I go, I'd like to have orders that have a date by when the home must be listed for sale, have our joint bank accounts shut down, and have her only surviving off monthly child support payments (until she eventually gets half of all assets). Until then, I suppose I will need to SUCK IT UP and stay in the house.
