I had a friend who got divorced and they had to, required by the judge, to stay in the same county while child support was being paid. Not sure if that's still a thing in Texas but she may not be able to run away with your kid without consequences. Remember you have rights as a parent too

Talk with a lawyer and probably will have to file first in the county where you currently reside. You want to set jurisdiction for your divorce in your current county. If not she may be able to file in the county of her new residence (south Texas). Plus once you file then things are put on hold and won’t change until your temporary order hearing.

Texas has no alimony for marriages under 10 years so don’t expect to pay her alimony even if she requests it unless she’s disabled or your daughter has special needs and your wife is taking care of her. Before you file split up your finances so she doesn’t take all the money. If your daughter is under 2 I think your wife will most likely get custody but you should at the minimum get every other weekend and a month during summer along with half of winter break.

Child support is a percentage of your take home pay and you can google the percentage but I think it’s 20% for one child.

Unfortunately there aren’t many attorneys who do free consults for divorce in DFW and it’ll cost you on average 300 per initial consult so do your research and close 2 or 3 that you think will be worth consulting with. Find someone who has worked primarily with the judges in your county.

Finally be careful for any false DV accusations. All the attorneys I spoke with told me to be diplomatic with the wife. If you do get into an argument leave before it escalates. Get the ball rolling before she decides to leave.

Get an attorney consult. Sometimes the initial one is free. If she leaves I am not sure there is much you can do as this child doesn't have any connections to the area yet. If the child were older and in school, has friends, etc. it would be much harder for her to do this.

As of right now there isn't much stopping her as you are still married. If you serve her and begin the divorce process she can still choose to leave with the kids, but it would come back to bite her in the ass come trial time and she would most likely lose all custody of the child.

As for my marriage advice, if a spouse is threatening separation, the marriage is already over. All trust and intimacy is lost as this is one of the worst forms of emotional abuse there is. Get ahead of the game and protect what you can while you can.
