Also to answer your question: Yes, but there's a 99% chance you will be liable for all her bills anyway in the current year. You might even get to pay off her student loans if you live in the right state!

In most leases you'll find that you're jointly and severally liable. So, yeah, until you and your wife actually file the paperwork, you'll be on the hook. But, it really doesn't matter. As part of the legal separation (you'll hit this point once you and your wife file the final paperwork) you'll be untangling all of it. The person who leaves the marital home is usually just removed from the lease. You'll have to work with the landlord to do that but it's pretty simple. I'd say I was concerned about her income qualifying for the lease, but with two kids, you'll likely be giving her more than enough to qualify after child support and alimony.

Assuming you're in the US, you can't file for divorce in secret. You can petition for divorce alone, but the filing is going to require her cooperation with tons of paperwork. You have kids, so expect to have mandatory counseling/co-parenting classes.

The most important thing you can do right now is to speak with a divorce attorney and get a realistic assessment of the maximum possible monthly damage you're looking at with child support and alimony. Once you see that number you'll likely need a bit of time to come to terms with it. You really want to wait until you're at peace with what you're looking at before you petition for divorce.

How long have you been married? Do you live in the US if so which state (state laws matter a lot). Do you guys have shared accounts/credit cards? Did you open the accounts/cards and just added her? Are the cars in only your name/both? Does she have a job/does she earn almost as much as you?

Yes you would still be held liable for the payments of the townhome and most likely you will still end up paying for your own place. I'm going to be really honest and give you some good advice. Find the meanest/most successful FEMALE divorce lawyer you can. Get your ducks in a row and start stashing cash away secretly (maybe with your parents?) Also you can "gift" money to your parents and a year after the divorce they "gift" it back to you lol. Look into draining the accounts you share and your personal one. Get your own inexpensive 2 bedroom place (you need to show that your kids would have their own room). Is she cheating on you at all/would she in a heartbeat? If so hire a private investigator so you can get pics/videos (they do help in the cases). Does she do any drugs/is tempted? If so then get pics/evidence of that and maybe even get the cops to arrest her. Are you overweight/disheveled? You may need hold off on serving her papers till end of the year so that you can get your ducks in a row/get into great shape. You need to project to the courts that you have your shit together and she is a loose cannon. Also ask for a physc test as you may be able to prove that she is physiologically/emotionally unstable (courts love that shit lol). If there is a way to get her parents on your side (above example of cheating/drugs) then that will help you A LOT. When judges see the women's own family turn there back on them/support then its a huge win for the father. In some states if you are married of under 5 years then its not a divorce but a dissolution which is a big different in the eyes of the courts. If she is interested in other men smile and support her marrying them (you will get off the hook for spousal support and a chunk of child support lol).

Sorry for the long reply but more info is needed and getting that female divorce lawyer/planning in absolute detail is critical for you to have any chance of not getting 100% fucked over. The chances of you getting beaten up some during this is still high but if it can be avoided/greatly mitigated then you need to be SMART.

You're likely to get pretty screwed due to length of marriage and 2 kids. Alimony and child support x2. You need to start hemorrhaging money/assets and getting it somewhere safe. Gambling, strippers, crypto etc. Lowering your income may not be out of the question. This may sound cutthroat and underhanded, but the ceiling for how high and long you can be screwed is infinite and you need to remember that. Protect yourself and what you can do for your kids in the future. This divorce will be kinder to her that it will be to you. Start planning now and lower that ceiling as much as you can.

Also consider getting back with her and blackmailing her. Go out drinking with her and record her being a fucking retard to get custody of the kids. Divorce is just a race to do the most fucked up thing to the other person first. Make sure you call the police and say you are scared for your life everytime you have to pick the kid up to get a record of her violent behavior that doesn't really exist. Maybe fall down or something and pretend you were assaulted by her and have her arrested. All this shit was done to me. I didnt just think of it.

Get on disability before the divorce. Otherwise the fraud psychiatrists will know what you are doing and you will not get it. Use something that women use. PTSD because someone put something in your drink and you were raped. Schitzofrenia is a good thing to have. Make the state pay for their crimes and for your child support like they should. Anything that you take or sell prior to the temporary order becomes yours. So raid the house. She would have to prove the stuff actually existed. Which would mean receipts for everything. But all that is probably just junk anyway. But it is up to you if you want it.

The debt is theoretically supposed to be split 50/50. So you may want to max out the credit cards. Her 50% of the debt will be deducted from what you owe her. And you could use this on child support payments if you do cash advances. You may want to just max out as many cards as possible. Pay child support with it. Don't forget to say you are making $500,0000 a year on the application. Then declare bankruptcy. The bankruptcy fraud attorney specialists will help you. But the thing about not paying child support is that you could go to jail. So by converting the credit cards and paying years ahead if time. You will be exchanging a bankruptcy for jail time.

If you're a traveling contractor, get your compensation reduced for 6-12 months. Perhaps a portion can be assigned as living expenses per diems, or travel expenses.
