Don't take any plea bargain. Don't 'admit' to a crime you didn't commit.

Just go through with it. The prosecutor obviously doesn't want to go through with it so 'make him pay' for his move.

Most prosecutors offer a plea bargain like that because it’s easier than going to trial and proving the case.

If you’re not guilty DON’T take the plea bargain and fight it. And if you have evidence that she said she’d do this to mess with you then definitely fight it.

Prosecutors overcharge and then plea down to what they thought they could get in trial anyway. It's a standard way to get a "win" without having to work. Best advice is listen to your lawyer. He deals with the system every day. The only exception would be if he advises you to plea.

There are many ramifications to pleading guilty (court costs, loss of gun rights, etc.). Based on your chance of winning, he's going to advise the "least worst" course of action, which may include a guilty plea. You would have to decide if the chance of losing is worth the guarantee of losing less in a plea.

It sounds like you've got actual evidence to back your side up. If your lawyer is excited, you might have a chance to win this.

Not to scare the shit out of you or anything, but I have a similar experience.

My previous (and final) relationship lasted about 2 years. At the beginning I felt great about myself and everything seemed perfect. By the end of it, she had blamed, gaslighted, projected, lied, cheated, and abused to the point my self-esteem was absolutely nonexistent. I might as well have been the beta poster boy because I just kept trying to give her more while she treated me with absolutely zero respect - she basically had me in the palm of her hand...(AWALT, as I now understand)

Anyway, we were living together in a small town about two hours from anyone I knew. One night she had gone out drinking, and I was supposed to pick her up at 10pm so she wouldn't drive drunk. She decides to ignore me altogether and drive home drunk out of her mind regardless at ~1:30 AM. I was very frustrated at this point because things like this were far too common with her. I asked her WTF her problem is and why she thinks it's okay to act this way. She responded by laughing in my face and telling me to GTFO or she's calling the cops (Of course, 24 hours prior to this she was talking about how I was "the one" and that she couldn't wait to have a kid with me). I understood that I didn't have a chance if police got involved, so I headed out into the freezing cold night (-20 degrees F or so) with nowhere to go. I called her several times after leaving in hopes of talking some sense into her. She answered the phone the first three times seemingly out of the enjoyment of the power she felt in kicking me out and ridiculing me. I continued calling to no answer, and ended up sleeping in my truck with it running all night to stay warm.

This wasn't even close to the first time she had done something like this, so I went to stay at my dad's place a couple hours away with the expectation that she would eventually respond my attempts to reach her as she had done several times in the past and things would go back to normal (I believe she was playing my fear of abandonment against me that I developed during childhood). Well, this time I was served with a Harassment Restraining Order instead, which was granted due to the 17 calls to her I placed on that cold night. To say the least, I was having a very hard time with the whole situation and felt absolutely devastated beyond words. So many times I had been though this viscous breakup routine with her, and she had always come back around and would tell me that I needed to "hang in there for her because she's worth it." Unfortunately, I was ignorant enough to believe this nonsense.

I made the mistake of messaging her on two different occasions over the span of 3 months basically asking her if we could talk about things and that I was willing to forgive her. She never responded to either message, and one morning right before work, the police hit me with an arrest warrant and took me to jail, where I spent weeks before I was even able to get extradited to the county where I had been charged. When I finally got ahold of some paperwork explaining my situation, I found out that I had been charged with felony fucking stalking...TWICE - each carrying a penalty of up to 10 years in prison and/or $20,000 fine for a total of up to 20 years and/or $40,000 fine. This was because of two text messages that were absolutely kind and positive. My bail was $20,000, but I was conditionally released because the jail was very small and COVID was in full swing.

I had never been charged or even suspected of anything like this in the past. Never had any kind of assault, restraining order, domestic, etc... Never had the cops involved for any reason related to any of my (many) past relationships. It took over a year to finally get the prosecutor to agree to two misdemeanor charges for violating a restraining order (which is the most I should've been charged with in the first place). The weekend before I'm supposed to have a court date to make the deal official, my ex filed a police report stating that someone had come to her house and tried to take a toolbox, and "she thought it was me." It was complete bullshit. I talked to the cops and offered to send them my complete location history along with financial transaction records for the day and time in question, but I think they already knew she was lying. Regardless, my court date was put off another month and a half so the prosecutor could "investigate the new allegations."

When my day in court finally came to accept the two misdemeanors, my clean history and her evil conniving bullshit made no difference whatsoever to the Judge. When I tried to explain to him what I had gone though in that relationship, he cut me off and said, "I don't care, and I don't want to hear it."

He then gave me the maximum sentence allowed by law for a misdemeanor on my first offense after having no contact with my ex for over a year.

First of all, it's a common act for a lawyer to try to mix stalking and sexual harassment. The bar for proof of stalking is incredibly low...any time she feels uncomfortable, it's stalking. Harassment has a slightly higher bar for proof, but they will try to accuse you of stalking, get a restraining order, then leverage that into a harassment charge. Are you talking about a prosecutor or her lawyer? Because in my state, harassment is a civil charge and not a criminal charge. The bad news is that most of your constitutional rights as an accused are out the window. The right to confront your accuser and review the evidence presented against you? Can be tossed away on a whim! Presumption of innocence? Not hardly! Ex-post facto laws? The judge can make them up on the fly.

Bottom line up front, it's very common for a lawyer (or a prosecutor) to throw everything possible...and even some things that are impossible...at you in the hopes that something will stick, that you'll just get worn out, or that a jury or judge will decide that with all of the accusations, you have to be guilty of something. Also, very common for them to try to blur the line between harassment and stalking.

"Malicious Prosecution" and "Malicious Use of Process" are some phrases the ex and her lawyer need rattling in their heads. One can get her lawyer disbarred, the other can slam dunk your divorce in your favor or worse, see some jail time for her (probably 30 days or less).
