This was all over the news here when it first came out that she had made a false accusation.

Back then people were going on about how she wouldn't be going to jail.

She's now been sentenced to 9 months jail, with a non-parole period of 5 months. This is in line with the average sentence for this type of offence (12 months, which would carry a 6 month non-parole period), so it's good to see the law being applied equally in this case.

What are your thoughts on this case? Do you think she should have received longer? If so, why?

Yeah, that pig should have gotten the highest possible sentence for her malice.

Why? The average sentence for that crime here is ~12 months. She received 9 months, presumably because she pleaded guilty at the first opportunity (which gives a small "discount" on the sentence for not wasting the court's time).

So given all of that, why should she have received longer? If she were male, the sentence would've been the same.

She has effectively ruined his life.

I agree! Her callous actions turned his life upside down, he spent a week in prison, his wife left him (though tbh if the wife left over this their relationship was probably doomed anyway) and I think he lost his job as well.

On the plus side, he can rebuild it. He doesn't have a criminal record, so there's definitely room for him to get it back together. He'll likely receive compensation from the govt. under the victims of crime act as well.

He suffered as a result of this, which is why she's going to prison, but it's quite frankly silly to think that a longer jail term would somehow "unruin" his life.

Now every time anyone runs a name or background check on him, the fact that he was jailed for sexual assault comes up.

Actually, if you google his name everything that comes up is how he was the victim of a false accusation. I just did it then, you give it a go and see if your results differ!

What record are you talking about? Most employers here in Australia ask for a national police clearance. Given that he's not been convicted of this, it won't appear on there and that means he'd be unlikely to be rejected for anything. If they google his name, the reports all flood in about how he helped someone and was the victim of a false accusation.

I highly doubt this is going to affect his life from this point forward. The damage has already been done and it doesn't look like it's going to get worse.

Do you even know how child support works in Australia? If you have no income, you pay no child support. It's a percentage of your income that you pay. He'll be fine. Having said that, does he even have children? I didn't see that in any of the reports, just that he was married and his wife left him.

Five months is not. fucking. enough.

You haven't demonstrated why. All you're advocating for is vengeance, which thankfully the courts in Australia don't go so heavy handed on compared to the USA.

Victim impact statements exist for a reason.

The punishment should be proportionate to the amount of harm caused, and this guy has suffered much more harm than 9 months in jail. Destroyed his life, livelihood, family.

I actually kinda feel sorry for her. I'm guessing she made the false accusation to show she was as "vulnerable," as all the more attractive women victim bragging on social media about the "creeps" that proposition them everywhere. If she were hotter, she probably would have been white knighted harder, and let off because she was "under a lot of stress" or something like that. Sub-average females have it the worst of anyone, they rarely have any kind of kinship with higher status females, and the vast majority of non-broken men have no interest in doing them any kind of favor since they don't want to insinuate flirtation. It has to be VERY hard as a female that doesn't get hit on, to hear all the "woe is me" crap from more attractive women constantly.

Sure I can have sympathy that life is hard. But cmon, can you please not lie about a rape accusation? It's probably worse than lying about a murder in terms of permanent damage to one's reputation.

This is like asking people not to commit crime. It makes sense to us, but we're not criminals (I'm assuming). It's not going to stop criminals from committing crimes, though.

Yep. Societies across the (Western at least) world have gone overboard when it comes to allegations of rape/sexual assault. They used to not take them seriously at all, which was horrible, but now we're at the other extreme where people can be locked up for months on the flimsiest of allegations.

I think all allegations should be investigated thoroughly. They shouldn't just turn people away or not believe them like they used to, but they shouldn't be locking people up on remand because some chick said something happened.

Agreed. They should be taken very seriously. Do you ahve any evidence to suggest that they weren't taken seriously. It is my understanding that police sometimes get jaded because they see so many false accusations.

According to Kanin's study, about 40% of women admitted to making up their accusation when they were made a serious offer to take a lie detector test.

Another aspect is that title 9 has exponentially expanded the definition of rape and sexual assault. There is a lot of weirdness and rape hysteria on campus.

That being said, it is a travesty that so many rape kits go untested. Actual rapists are scum and need to be put away.

You probably didn't do it deliberately, but your first reaction was to coddle her and make excuses for her, despite what she did being just as scummy as it would have been if someone of a different gender did the same thing.

Interesting take on it, not necessarily one I agree with (the post really has an anti-woman vibe to it), but I appreciate you commenting nonetheless.

Do you feel that the sentence she received (9 months in prison, possibility for parole after 5 months) was adequate? Should it have been more? If so, why?

I suspect many other false claims in Australia go entirely without punishment, so I'd actually say it probably isn't fair. Again, I think the media portrayal and sentiment towards this woman wasn't sugar coated like it would be for an otherwise attractive female.
