It's an example of an atmosphere that Douglas Murray summarized as "We are pretending to know about things we don't know and pretending to not know things we've known til yesterday."

Risk-management consultants travel the country to help colleges craft legal rules for student sexual congress. These rules presume that an activity originating in inchoate desire, whose nuances have taxed the expressive powers of poets, artists, and philosophers for centuries, can be reduced to a species of commercial code.

The process of crafting these rules combines a voyeuristic prurience and a seeming cluelessness about sex. “It is fun,” writes Alan D. Berkowitz, a popular campus rape lecturer and consultant, “to ask students how they know if someone is sexually interested in them.” (Fun for whom? one must ask.) Continues Berkowitz: “Many of the responses rely on guesswork and inference to determine sexual intent.” Such signaling mechanisms, dating from the dawn of the human race, are no longer acceptable on the rape-sensitized campus. “In fact,” explains our consultant, “sexual intent can only be determined by clear and unambiguous communication about what is desired.” So much for seduction and romance; bring in the MBAs and lawyers.

The campus sex-management industry locks in its livelihood by introducing a specious clarity to what is inherently mysterious and an equally specious complexity to what is straightforward. Both the pseudo-clarity and pseudo-complexity work in a woman’s favor, of course.

“If one partner puts a condom on the other, does that signify that they are consenting to intercourse?” asks Berkowitz. Short of guiding the thus-sheathed instrumentality to port, it’s hard to imagine a clearer signal of consent. But perhaps a girl who has just so outfitted her partner will decide after the fact that she has been “raped”—so better to declare the action, as Berkowitz does, “inherently ambiguous.” He recommends instead that colleges require “clear verbal consent” for sex, a policy that the recently disbanded Antioch College introduced in the early 1990s to universal derision.

Apparently any alcohol places all responsibility on the man. Alcohol being used at the time of signed consent negates the contract and you’re solely responsible for what ever may be accused. If it’s regretted then it was assault.

Let me give you a personal example of this kind of circumstance:

Summer 2019 - I started seeing a woman (38) in June. Never married, good looking, cooked and had a good personality. Our third date was at her place for dinner and the Uber to a local bar in her area. After hours of drinking and karaoke we got back to her place, walked into her kitchen and she immediately pulled down my shorts and, well, she had soft lips.

At this point I was near the end of divorce proceedings in which I was being totally destroyed. At the end of July, the divorce was final but so was my last business. When the business closed I didn’t have any spare income, time to date or a desire to date.

On top of that, she informed me that she maybe 38 but she still wanted children. Wtf. Anyway, I spoke with her and told her my situation and that I didn’t want to and couldn’t continue to date her.

About a week after I had spoken with her I received a message through Facebook.Here is the exact text:

“I’ve been really thinking a lot lately. I'd Ive waited a bit so say this. All of this. For the record I am embarrassed I drank too much the night you and I went out and had sex I feel really stupid that I don’t remember much from that night. That is not something I do on the regular. Where I think you need a little work yourself getting close to someone like that and then completely blowing them off. It's completely rude. I was cool as hell with everything going on in your life. You pulled a "dick" move.”

Watch yourself man. No matter how you handle yourself or what’s going on with you, it will always be your fault. Remember, she ripped my clothes off. I did nothing to instigate.

I don't think this would help. In Australia any contract is void if you were drunk when you signed it, and I imagine it would be similar in Georgia (country or state). Anyone already crazy enough that they would make a false accusation of rape could still do so, either by

1) claiming they were intoxicated. Even if they were totally sober, they could just lie and say they were drunk. As long as they wait a few days after signing, there is no way for you to prove that they were not drunk.

2) claiming that you violated the contract by going further that it allowed. For example, they could say that, after a while, they said it was time to stop and you ignored them. Or that they set specific limits (eg no anal) and you ignored them and forced them to do stuff they didn't want to do. Again, they can just wait a few days/weeks before making the accusation, and that way they can explain their total lack of physical evidence.

I don't think there really is any way to protect yourself from false accusations, other than by only sleeping with people you really trust. Or you could film the whole date (from meeting up with her for dinner to sex to whatever you do after that) so that anybody watching can see that there was no force or coercion used the entire time you were together, but that might kill the mood almost as much as the contract would.

A contract is not valid if the person is on drugs or later claims to have been on drugs.

That's the whole purpose of having a notary witness the signing of a document. They can later testify that both people were of sound mind when they signed it.

I don't think there are many false allegations that are completely random like that though. Usually they're because the girl has a boyfriend or something like that. It becomes an excuse. It does happens but unless there are red flags, I wouldn't worry about it too much.

That form won't help you. You remember consent can be withdrawn at any moment.

Focus on avoiding insane persons. It's quite easy to spot them.
