One of my firsts posts here at Reddit was that I got arrested on trumped up charges. Three days after I filed for custody, my ex went to the police and said that beat her. The police didn't believe her, but a bull dyke of a DA did and charged me. About 6 weeks after I was charged, my ex was mad because I wouldn't give her more money. After calling my lawyer and demanding another $300, I refused, she called the Army and said that I went to her apartment at lunch and tried to kick her door in. She took photos of my running shoe marks to "prove" it.
I actually had worked through lunch that day, and was wearing boots. I was in a secure facility with CCTV security cameras. So that destroyed her case. Shortly after the State dropped the charges, the Army cleared me in their investigation. They then went on to declare me a victim of abuse. I pushed to get her charged with filing a false report. The Army doesn't charge civilians, so they reached out to the State. The state said it was a Federal matter. The Federal AG decided that it wasn't worth dealing with such a small case.
Then to add insult to injury I was forced out of the Army, because the new female CPT refused my re-enlistment. I had just gotten an exception to policy memo to get to OCS for my age with the NG (National Guard). Basically I would serve active while doing the 1 weekend a month, then get my commission and then let the Guard and Active fight over me. I had the COL offer to sign my re-enlistment, but he wanted me to PCS to another base. I couldn't do that, because the courts failed me and said I wouldn't get 50/50, I would get a weekend visit with her. So I talked to the Guard and they said OCS (Officer Candidate School) was still on.
So I ETSed. Right after I ETSed, someone in HRC (Human Resources) decided that I couldn't go to OCS, because CID still had me pending criminal charges. Despite the documents proving otherwise, that technicality booted me from OCS.
So needed to find a new career.
Since I used to be a teacher, I went back to that. Unfortunately, when I applied to the Department of Education, the case was sealed, but the arrest for DV was still on my record. The courts failed to tell me that was a different thing and I had to do some extra steps for that to be removed. They noted it and refused my license. I had the record fixed, but the Department of Education had it noted I was arrested for DV. Got to know 2 principals and managed to get them to recommend me and offer a job to me. The district refused, because the arrest.
During this time, my ex was arrested for felony theft against the elderly (2nd Felony, in 2004 she was caught smuggling 46.5 pounds of cocaine and only did 3 years on that. How many guys get that kind of sentence for that many pounds?). She used her stories about abuse to justify the theft. She got a 2 year sentence, and they suspended it. She claimed she stole to get money to escape abuse, despite me being the one who filed for custody.
She was later arrested for false imprisonment. I was pressured into getting my daughter at her place, I recorded the audio and she demanded we fix the relationship and talk about it. I finally left with my daughter, she trapped me in my vehicle. I called the cops, they arrested me for supposedly shoving the door open and barging in. Audio saved me, she got arrested instead.
If she was found guilty or pled, she would get to do those 2 years, it was the Sword of Damocles.
So day of the hearing, the DA had 3 cases scheduled for the same time. Judge said pick one and either plea or dismiss the others. She said she didn't want to deal with putting them off. Guess which case got dismissed? Mine. She was required to get one psychological evaluation and they dismissed it. The DA told me to learn to handle it better and besides he called the DA in my county and that DA said it was a clear cut case and felt no risk of losing it.
Courts failed me again. She skated and I didn't get justice
But while waiting on that case about 2 months earlier, she was arrested again for violating the restraining order. She had taken naked photos of me in the shower when we were dating and was threatening to send them to friends and family.
So that was 2.5 years ago, the trial has been repeatedly delayed due to the pandemic. Finally it was going, Monday I was called and told that this case was going to be heard and that they had everything ready to go.
Finally, I was going to have my day in court, they said the case was so air-tight with her admitting to the texts, and the restraining order being so specific. I was thrilled, finally I was going to get my daughter.
Today, I got a call. They were dismissing it. Why? It was air tight, they told me that. Well it ends up they used an unofficial copy of the restraining order and 18 months ago the judge told the DA to get the official copy of the restraining order. Ends up that POS in the DA's office left to a better gig. So no one did it, until today, when it was pointed out the copy of the unofficial restraining order and not the correct official one.
Since the previous case is sealed, the DA asked for a month's extension. The judge refused, said they have to present the correct restraining order tomorrow or it is dismissed. So once again the courts failed me.
I asked for them to go with the harassment case, but they said without the restraining order, they didn't feel a jury would accept it was harassment. Not sure how threatening texts about naked photos being sent to family and friends isn't harassment, but in this county the DA says it isn't.
Oh it gets worse, my ex has had 2 CPS cases filed by her now adult son (just turned 18, once at 15 and once when he was 16), and both times the family court decided counseling and parenting classes were the best option.
My daughter turns 5 in a few months, she is about to start school. I have no faith in the courts siding with me and one of us is going to lose, because I moved across the state to stay way from her. My daughter plays with a little girl, who lives with her dad. Despite the fact that her mother was a meth head for most of her life, she has cleaned up in the last year. The courts are moving to them having 50/50.
I never understood how some guy going through a divorce could off his ex and then turn the gun on himself. I don't find it morally acceptable, but I definitely can understand why it happens.
How many times can the court fail me? This wouldn't even be an issue if the judge would just wait a month to get the document. I don't understand why the judge can't understand that they have had 4 DAs quit during the time on the case. It is easy to see how the ball was dropped. Instead the courts would rather fail me again.
