Lawyer up now, document everything, save and screenshot every interaction. Immediately get into 'cover your ass' mode. If you can record phone calls, and any in person communication (even though theyll likely be inadmissable in court, it can show a pattern of behavior)

Trying to keep the baby from its mother is just going to make you look bad in front if a judge.

Be reasonable and get a lawyer and request 50% custody. Be well put together and don't put down the mother just argue your own case.

You might not get full custody while baby is exclusively breastfeeding but hopefully will by 6 months. If baby is on formula you might get it right away.

The worst option is the most likely: you don't get to see your kid (except visits) but you have to pay a third of your income (including the disability benefits) to support the kid.

A slightly less bad option is that you are not put on the birth certificate and then you don't have to pay but you can never ever see them. This is basically the male equivalent of having a miscarriage.

The best option for you is the least likely by a long shot: that you get primary custody and can collect child support. As an unmarried father this is basically unheard of. To say nothing of allegations that will lower your odds even more.

The best option for the kid is highly unlikely but not unheard of: 50/50 time split with both parents and their financial needs split equitably based on relative income of each parent.

1) Get in touch with a custody lawyer before this goes any further. Like, ASAP. Unmarried fathers have the hardest time getting even visitation, much less custody. It doesn't mean you can't, but it does mean you need to get your ducks in a row and you don't have any time to waste.

2) Read this https://www.floridahealth.gov/certificates/certificates/birth/Putative_Father/index.html and check with the lawyer you get into contact with to see if you need to register as her child's putative father in order to protect your custody rights. If you were in Ohio, you definitely would.

3) No matter what else happens, demand a paternity test. I know nobody likes to hear this, but there is no such thing as a 100% guarantee that she was loyal when you were together. If you are going to get emotionally invested and sink a lot of money into a custody battle (and they are expensive) you should be 100% certain the child you're seeking custody of is yours.

4) Document all communications. Save texts. Prepare for her to be angry if you file a civil action to obtain custody. Be aware that angry women can use false allegations as a weapon and never face any consequences for doing so. If she makes a false allegation of intimate partner or sexual violence, you will wrongly be presumed guilty until proven innocent. Be ready to fight that battle with documentation of your communications & hers, your history of communications & hers, and concise documentation (time, date, location, receipts, photos) of your whereabouts and activities, as much as possible. Make it hard for her to lie about you without being proved a liar.
