"There is a possibility that the policy may disproportionately affect female offenders as women are more likely to meet the new criteria for killing one or more of their own children. Our proposal will operate within the existing Schedule 21 framework so that judges have the discretion to depart from this and impose a high minimum tariff where appropriate. Where women are found to have killed their own child or children, The Crown Prosecution Service (CPS) may bring a charge of infanticide or manslaughter rather than murder. Such offences do not have a whole life order as a starting point and are not affected by these proposals." (Policy D section)
