From the court filing, as quoted in the linked article:

  1. The Texas A&M University System, along with nearly every university in the United States, discriminates on account of race and sex when hiring its faculty, by giving discriminatory preferences to female or non-Asian minorities at the expense of white and Asian men. This practice, popularly known as “affirmative action,” has led universities to hire and promote inferior faculty candidates over individuals with better scholarship, better credentials, and better teaching ability.

  2. These race and sex preferences are patently illegal under Title VI and Title IX, which prohibit all forms of race and sex discrimination at universities that receive federal funds. But university administrators think they can flout these federal statutes with impunity because no one ever sues them over their discriminatory faculty-hiring practices and the Department of Education looks the other way.

  3. These discriminatory, illegal, and anti-meritocratic practices have been egged on by woke ideologues who populate the so-called diversity, equity, and inclusion offices at public and private universities throughout the United States. The existence of these offices is subverting meritocracy and encouraging wholesale violations of civil-rights laws throughout our nation’s university system.

Not mentioned in the article:

I have reached out and provided a dossier of documents and internal emails from within the Texas A&M system showing negligence in handling complaints of discrimination, from issuing fake rulings, handling cases off the books, and not responding when I alerted the System Ethics and Compliance Office to the issue.

For me, they didn't officially file my complaints of discrimination while working them. They used this as a way to avoid oversight and avoid affording me my rights. They held the cases in review and in the dark from oversight while they made changes to the programs in an attempt to get them compliant. They then dismissed the cases as "no violation" despite internal emails showing a different conclusion. This let them avoid disciplining faculty involved, like one director who argued in a 2016 publication (while employed by the school) that Title IX justified discriminating in school engineering programs by forming all-women engineering teams, something she was doing, and continues to do despite my internal complaints.

They didn't investigate the complaint of Zahra Shahrashoob who is also suing them for employment discrimination. When she had complained of a pay disparity issue (her court filing looks extremely compelling), they responded by not investigating and reducing her contract term. I know the pay gap isn't a thing at-scale, but for both men and women as individuals, it absolutely does happen. It looks compelling that she was being paid less than people with similar qualifications based on her race / sex.

In 2020 there was another court case where a male was found guilty in a school Title IX tribunal despite having nearly double the BAC of his accuser. The school only interviewed witnesses the accuser wanted (ignoring most of the known witnesses), and never officially filed his complaint that he was the one who was sexually assaulted. They assigned his case to someone going on maternity leave while they selectively processed his accusers complaint. The fact that his complaint was never officially filed was used to deny it's consideration in the final hearing where the school declared him guilty.

There appears to be a pattern of reckless negligence to Title IX complaints within the school system. Despite being aware of it, there is a distinct lack of action by the System Ethics and Compliance Office in fixing the problem. This is a callous disregard for federal civil rights laws by this university system, and it looks like they are finally being brought to task on it.

I really hope he wins. I have had an issue with this and title IX for a long time. It's a gender neutral title, but it's literally only applied to women. Take sports, title IX is used for the basis of sports non stop, despite not mentioning athletics, it's ONLY used for women. We are yet to see male field hockey get any love for example despite a shit ton of men wanting to play that sport. It's offered to almost exclusively women - not to mention the amount of schools who disallow male cheerleaders and have no male cheer team or anything either.

Title IX is suppose to promote equal opportunity for both sexes at public schools, yet they funnel a lot more money into female resources and scholarships (evident by the increasing ration of women over men in schools in the recent decade), it's a gender neutral document applied in a very sexist way. And it happens to be in an EXTREMELY important area, this isn't like getting into a club or private event for an evening, this is something that has an impact of opportunity for life.

I was mostly agreeing until your second paragraph. A few claims with no supporting facts. More money for women? How so? Where? When? And if that's true, how does that lead to the increasing "ration" over men? And what "ration" are you referring to? Did you vote for Trump?

90% (thereabouts) of Affirmative Action benefits have gone to white women. Why do you think it is still around, or so defended by feminists? Do you really think they would stump for 'the coloreds' if there was no gains for them? Stump for black MEN in particular

I don't think these groups give a fuck about black people. It's par for the course that people in power only pander to their issues instead of helping. They have long lacked any serious consideration in power. My personal take is this is a class issue. Poverty disproportionately impacts POC, and power represents high economic class interests first and foremost. Always has. Time to stop pretending it doesn't. Solutions should be appropriately tailored to addressing the economic class issue if we want real inclusions and empowerment. My thoughts below:

AA programs were supposed to be short lived and targeted at schools that had deeply engrained bias and were resistant to overcoming it. Discrimination is invidious wherever it occurs, so it should only be used as a tool when it has a limited lifespan and is very specific in overcoming the issues internal (not external) to the institution. Schools that didn't want women and POC should be forced.

When women have been the majority of degrees and students for decades, it can't be justified based on sex anymore.

Ignoring sex for a moment, I see the biggest discrimination issue for education being based on economic class, which then has disparitate impact on race, mainly BIPOC.

What really gets me is schools like UMich that spend 10mil on DEI salaries per year. How many students would have access to these schools if that money was put directly into paying for tuition for low income students, or first generation students? A conservative estimate would be an additional 250 students. It hurts to even think about.

I want to see my tax dollars and tuition money supporting lifting people out of the shackles of poverty rather than bloated admin pandering lip service to the issue. Isn't that the American dream? A nation of strong class mobility? That a persons position limited by their current position, but their motivation to change it? We can't solve this problem without looking at class struggles.

When it comes to AA for BIPOC, I do still support it, but not in its current form. It isn't transparent enough. Places like A&M still suffer from very real racial discrimination within the school (I saw it first hand). They need real AA to fix their shit, not 100k bonuses to minority faculty (subject of a new lawsuit by Richard Lowery).

Even then, I think it would be better for schools to target low income BIPOC school districts with special scholarships not based on race. If you get a halfway decent GPA in a shit school it means more than getting a perfect GPA in a private 30k/year high-school with private tutors. Those bloated salaries should be used to pay for free rides to flagship state schools for first generation students from shit schools. This wouldn't be nearly as divisive as these opaque AA programs that simply pander and run a grift where a huge chunk of the money is spent on "administration."

"Inclusivity" and "everyone should feel welcomed" are insulting phrases when schools don't take real direct action at eliminating the number 1 barrier, poverty.

As a personal story I haven't shared yet, a friend of mine got a scholarship like the one I described. On a paper application he looked worse than my application. But I went to a stellar public high school that ivy leagues recruited from and had parents who had the time to help me learn as a grew up. He didn't have that. His parents had to focus on putting food on the table and keeping the lights on. When he got to college he fucking thrived. It was his chance to escape poverty, he saw it, and he wasted no time or effort in finding success. We need more of this, and less pandering. Most AA I see now is pandering.

A shift to class-conscious programs over whatever the fuck "DEI" these schools are running will have substantially more impact. I care about impact.

I am not saying real issues of discrimination don't exist, but rather that if we want to have greater impact, we might to change how we tackle to problem, and that it is a bit weird DEI programs forcus on "feeling" included over being included

Another friend of mine was a dual citizen with USA and Mexico. Lived in a cartel town where his parents owned a humble chicken farm. He had a similar story where he got a lot of help, breaks, and scholarships along the road to graduation. He nearly failed out after coming back from summer at home. That summer was wracked with violence due to our governments "operation fast and furious" and it fucked him up bad. Those breaks and leniency made it so he could still escape the bullshit. That is real DEI, not 100k bonuses to minority faculty. That is where our money should really be spent.

Take that money and bring in 250 students like this. Even if half end up not being able to make it, it still did more and sends a stronger message than paying bloating salaries for dedicated faculty to tell the students they all belong.

Real DEI is hard and often requires getting to know all the students. With massive classes and treating students like cattle is gets very hard to take the time to get to know students and actually care. So they pander.
