Rape is under reported, but figuring out how many people DIDN'T report rape is really hard to figure out. The best numbers are in the range of 70-90%, 97% is just a fabricated number.

It supposedly comes from the Department of Justice as indicated as #5 in this infographic. I tried to find that summary report at the DoJ by using their website search engine and came up with zilch.

Perhaps you should ask who 'informed' you where they got their stats from.

The more minor a sexual assault is, the less likely it is to be reported. Someone giving a butt an unwelcome pat is less likely to get reported than something more serious, like an attack on a stranger which causes injury. It's like the "rape or sexually assaulted" statiistics; it is not the rapes that make the figure high, it is the sexual assault, which might include an unwanted kiss. Given the range of actions covered by the description "sexual assault," the statistic is pretty well meaningless.

How can any number of assaults be determined without a report? If there's no report, there's no police investigation and if there's no police investigation, how accurate can any of these numbers be?

I would use the number about 5% go to jail.

The implication is that 95% don't have enough evidence to prove guilt meaning that they are innocent in a court of law, have evidence but are proven innocent, or are flat out lying (ie no evidence).

However, that won't go over well with some types. It's sound logic, but it doesn't play well in a crowd with the current state of the general mindset.
