I've said it before, I'll say it again: nothing is more sexist against women than these sorts of rules about drunk sex being rape.

So you have a guy and a girl who have sex. Both of their BACs are above the threshold designated at the rape-level. But the guy is a rapist, and the girl is a victim.

So you're saying that the man had full agency but the woman had none?

So we're saying that all else held constant, at any given BAC level, the man is presupposed to have more decision-making ability than the woman?

So you're saying that being a woman is a mental illness which diminishes a person's decision making ability compared to if they were a man?

If feminists truly cared about equality, that would have been the first thing they attacked.

Women don't mind being perceived as children when it benefits them. Case in point just about any argument I've ever had with a woman.

Feminism is just a reflection of that. They are the spearhead for the feminine imperative that pushes for more opportunities without any responsibilities.

The flaw in the argument is that this is truth. The main problem in so many areas is that society forgets that, e.g. women's suffrage.

You're making the mistake of thinking that feminism is about equality all of the time, rather than just the times that it benefits them. You see in this instance feminism wouldn't have benefited her, so no she doesn't have agency, but only in this limited circumstance.

This is the opposite of what you would find the average of real rapists to be.

Real criminals tend to have a lower IQ, come from bad families, have a poor GPA and never come close to being the class valedictorian.

These are the same attributes (GPA, sports team extracurriculuar) that they use in admissions. So the college prof is saying that their admissions criteria selects or rapists. So maybe the girl should sue the school!

Girls LOVE succesfull guys. So they date and fuck men with a high GPA who are in a sports team and from a good family. They get no relationship out of it and THEN it is rape.

And BECAUSE this happens so fucking damn often - happens SO FUCKING OFTEN, suddenly we have a PROFILE for those guys. Suddenly this PROFILE becomes that of a Rapist, because OH MY GOD, those girls get raped from yadda-yadda-yadda-guys-from-a-good-family. And with each girl, who fucks a succesfull guy from a rich family, and afterwards regret it, those men become even more of a rapist.

We have a MAN and a WOMAN doing something together. Lets say, Woman like BLUE Men, like blue from head to toe, lets just assume this. Lets talk colors here. They dont like the yellow men so much, they dont like the red men, and they just hate the gray ones. Now they fuck. Who wouldn't fuck a blue man, right? Afterwards, for some dumb reason, the girl just CLAIMS, it was rape - Of course it was not, but she says it and everbody believes her.

BAM - we have our first blue rapist.

This happens more and more - BAM and DAMN, those blue men sure are rapists.

And now you're a blue man, dating a girl, fucking her, because she wants you inside her. Next day, you're a rapist, because, well there is no evidence, but we know you blue men, you're all rapists!

NOw we will see if the right to sue schools has any meaning or not. If the settlement is a few thousand bucks then the schools will gladly pay it and keep on violating peoples rights. If it is tens of millions they will get a strong and sudden respect for basic human rights. If it is in between then how far it leans in either direction will dictate how schools react. I'd love to see the an award that would make even the wealthiest schools cringe but I'm not holding my breath.

This case has potential to be front page news and monumental. THE FUCKING LAPD HAS EVIDENCE THAT IT WAS CONSENSUAL. If the girl texted him asking for a condom as the article states, game over.

Yet the college has made up a false reality to push their agenda.

I'd imagine any young, ambitious lawyer would jump at this opportunity pro-bono.

I'm curious if defamation is criminal California. It's a criminal misdemeanor where I live in Louisiana.

This clown university court isn't privileged. It cannot make criminal accusations, at all. All criminal accusations must be made in a privileged courtroom. Even the smallest assault charge or speeding ticket must at some point be processed through, and in front of, a privileged court.

This is going to get messy, and it's going to get messy fast. People are probably going to have to start posting some bail, too.

These guys they are expelling aren't the typical living on ramon noodles, working two jobs, in student loan depth up to his eyeballs working class shlubs. These guys are from families who can afford the lawyers and will want blood.

The school would rather destroy the guy and pay him off afterwards then be positioned as a patriarchal institution that tolerates rape on campus.

They're more concerned about their social reputation and the repercussions to their profitability than any truth or justice here. It would be admirable if they did the right thing, but they'll protect their bottom line instead.

Well that is where the settlement comes in. If it is 50 or 100 million dollars, perhaps an exaggerated example but it makes the point, all the schools are going to swallow hard and suddenly have an epiphany that rape is a serious criminal matter that should only be handled by the police and courts. If it is twenty or thirty thousand then they will just keep on doing what they are doing. I'm hoping for a jury that will return a number that would rattle an automaker.

I read the entire lawsuit he filed against the school. I have to say with unbiased interpretation I think it's pretty clear what happened here. She got super hammered, was used to people "watching out" for her, went to her "attackers room", lost her virginity and felt bad about it/regretted losing her virginity that way (basically how she wrote it out).She even was sitting next to him in class the next day.

I like how she didn't want to file a report but did so when pressured by her professors. Wow.

Not to continue with the obvious, but how many guys could possibly fit that profile? How many guys in a school can claim to be not only a class valedictorian, an athlete, and to come from a good family? Maybe 5-10 at most?

How could you possibly have a profile for such a small demographic?

Besides... dont they find it strange that the demographic least likely to need to commit rape is also the one that supposedly commits so much rape?
