My business partner is going through a tough time and doesn’t use Reddit, thought I’d run some questions by him on here since he isn’t happy with his attorney:
Some facts: He’s the sole earner, about 100-140k income, taxes haven’t been done for 6 years and he’s about to file now. Married for 14 years, 4 kids 5-12. Both live in the same house but she’s tried multiple times to kick him out even though he wouldn’t be able to afford to live. Wife SAHM 9 years no job, 33 yo in good health.
Right now he’s covering all expenses even though he can’t afford them with new expenses that have come up(family therapist, paying for his wife’s new therapist, tutor for his youngest daughter who has been homeschooled and just tested 2% percentile reading and writing). He’s paying his wife 1600 a month. Divorce has not moved since January and he’s been paying her the 1600 since.
He’s realizing he’s running out of funds on a monthly basis and can barely afford to make ends meet. Wife thinks she deserves more than 1600 a month and says she’s broke.
He wanted to stop paying for his wife’s therapist and make her pay from her 1600. Attorney said to tell her he’s still going to pay for wife’s therapist, but reduce the amount he’s paying her monthly instead.
Now all this is said, then the attorney says she will probably go for spousal support even with all the evidence of new expenses and taxes being done because she will be unhappy. When asked how it would be determined since he can’t even affford the 1,000, attorney said he’d have to argue his side but that the judge can just pull a number out of his ass and taxes won’t matter since she will cry for a forensic accountant since “businesses can hide money”. According to attorney he would be stuck with paying whatever the judge awards until the forensic accountants are done which could take “a year”.
