If this was a male teacher, and a 16 year old girl, we as a society would be NAILING HIM TO THE CROSS! He would be forced to register as a sex offender, he'd have a felony on his record, and never be able to teach or anything ever again. We would ruin his life by saying a "16 year old girl doesnt know what shes doing! You raped her!"

Let me start by saying that I don't agree with this at all, as if the genders were reversed, there would be no leeway and probably greater pressure.

That being said, I have little problem with the actual event/relationship. This may be my bias because I'm Canadian (age of consent here is 16). Although in this case because there's a relationship of authority (teacher-student), that is raised to 18 years old. In Louisiana, the age of consent is 17 (21 for authority figures); if one were to delve into it further, how close was the boy to turning 17 at the time they had sexual relations?

The whole point of an age of consent, IIRC, is because of a mental development/maturity issue. I know the law provides little to no leeway, but an argument could be made that if he was close enough to the age of consent, he had the effective maturity and soundness of mind in order to make such an informed decision.

It was an entirely consensual affair and AFAIK she did not use her authority over him in any way to entice him or coerce him into these acts (i.e. "sleep with me and you'll get 100% final grade" or something along those lines).

IMO, there should be no age difference for sexual relationships whether a relationship of authority exists or not. As long as there is no abuse of that authority (which should not happen at any age, even if both adults are 30+, as this is not true consent, but coerced consent).

Let me reiterate that in the eyes of laws as written, I do not condone or endorse what has happened. I still believe that she should be charged accordingly (felony, sex offender registry, the whole bit). That being said, I also believe that some changes might be in order for legal systems regarding ages of consent - someone who is legally allowed to have sex should not be punished (or cause their partner to be punished) because they have a secondary age of consent to pass...and certainly not a 4 year difference.

St. Charles Parish District Attorney Joel Chaisson II personally handled the matter 24 hours after the plea, amending Dufresne's charge to a misdemeanor and allowing an ad hoc judge to accept a fresh new guilty plea over the telephone.

In a written statement, Chaisson noted that Dufresne's terms of probation remain the same under the new plea.
