Make sure to find the case law and federal law that sites they can’t use your military career against you. I would absolutely be fighting for 50/50 custody. She’s most likely going to be trying to go for child support and probably as you’ve suspected moving out of state. Which is why she’s getting so aggressive when you bring it up. make sure to see the kids as much as you can and document it as well.

I just finished spending 15 grand on the contempt motion against my ex for $10,000 worth of shit that she did not handover at the end of our divorce. The main reason I would not let it go was because of the 10/22 My dad gave me When I was 18. I’m sure she spent at least the same on her Lawyer. I had video of the day I left and the day I was legally allowed to come back. It’s been a month and a half since the second day of the hearing and I’m still waiting on a decision from the magistrate.

Basically, the way a lot of judges look at protective orders as they air on the side of caution. So whatever bullshit she says they try to give her the benefit of the doubt personally I was evicted by CPO before my divorce got kicked off. She even moved her boyfriend in a couple of days later.

I think the one thing that was pointed out was go speak with a doctor and have them do a work up and a note saying that is medically necessary for you to quit one of your jobs. And submit the paperwork to the court stuff like that forces a judge or magistrate to reevaluate their bullshit Orders.

Yeah…… i’ve literally had the cops called on me for sending court paperwork. We closed on the house like a month and a half ago. The divorce was back in January and she had a year and a half before that to move whatever she was going to, but I’m hoping that the judge will put the fear of jail time on the table for her, not handing the stuff over.

My suggestion would be to play the long game. Document the days that you have the kids offered to take the kids on more days. Do this for about six months to a year and then take her to court. I’ve heard about women documenting the days and the court, taking it like a Bible. Your argument will have a whole lot more weight when it shows that you’re already seeing the kids that much the court really doesn’t care or think about the money aspect of it.

One of the big reasons that I agreed to it was the objection and appeal timeline. It could be a year or more if I had to go to the appeals court. And all of that time I would not even be allowed my second amendment rights. So having a deal where I get my second amendment right back no alcohol restrictions. And where explicitly says that all property matters will be settled by the divorce proceedings was really the best that I could do given the situation

If you’re unable to get a lawyer, make sure to have printouts that she removed the money from the account. If it was after you filed for divorce, you need to file a contempt of court for her violating the TRO that comes with your divorce proceedings typically if it’s under 10 years of marriage the chances of her getting alimony is low. You need to look into the services that are available to you on base like going to the base legal aid.

Their biological dad hasn’t been in the picture for over four years. All he cared about was trying to get out of child support so once court was finished, he stopped seeing them. He pays child support but doesn’t call or see them and I looked at it as they were a package deal. I love my step kids very much and miss them every day.

I would pick a police department halfway between each residence as an established turnover area. Don’t feel like you have to make all the effort. It is perfectly reasonable for her to meet you halfway. Police departments have security footage in between the security footage if needed and the text message log it’ll show that you were doing your due diligence to communicate and attempt to exercise your parenting time.

It’s really not that hard to file a contempt of court motion. The clerk of the court will tell you what forms you need to fill out. They’re pretty self-explanatory make sure to fill it out, though the first time will be a slap on the wrist most likely, but if she doesn’t repeatedly, it could turn into her losing custody. You have to show that it’s a consistent behavior.

If you guys have already started your divorce proceedings, you need to file a subpoena and in the subpoena you can request her to bring financial statements, so she hast to show where the money is at where it came from. Think of it like you’re doing an IRS audit on her bank statements, tax returns, etc..

Find the domestic relations court for your area and go to the clerk of the court and ask which forms you need to fill out they can’t give you legal advice, but you can explain what you’re trying to do and they will give you the right forms

They make it super easy for women to file to get a CPO they even have but they call an advocate to help them fill it out just be prepared unless she’s completely full of shit for them to decide with her. So I have a plan or cash, set aside for housing, and make sure to have more than one vehicle, so you’re not left in the lurch

I would seriously put it out to you to get a mutual restraining order before she kicks you out of the house. Ask me how I know. I can’t stress it enough that if she’s serious with the divorce you need to get your head around that and start acting like she is an adversary in court.

I definitely feel for you I’m in the middle of my divorce and dealing with a bullshit CPO. I just went through my initial hearing, and it felt like a kangaroo court. I wasn’t even given a chance to do my statement the only silver lining I can give you is that if you’re moving out of state, just hope for a mutual no contact, they are treated differently than having a CPO. Going through a divorce myself. But I am the odd man out there my step kids, so I have no rights. Haven’t gotten to see my dogs in weeks or be at my home. Be happy you’re getting to spend it with your kids. Hope the best for you.

Unfortunately, there’s a few sticky problems with my situation. They’re my step kids and I care about them and only one of the dogs out of the four is going with me and the polish it all off she got a CPO and at this point, I realize that being in that house is going to be more toxic than me dealing with getting an apartment. But it is all temporary and eventually the divorce will be final and I will be able to move on.

As long as you all are civil About it you don’t need to get a lawyer. You can get a annulment for the marriage. And you guys can either work it out amongst yourselves about custody and child support or through the court. that being said, don’t agree to anything that sounds ridiculous. Even a normal divorce. It’s 50-50 and child support is based on the child receiving the same lifestyle in both houses.

It would be my impression that you could either borrow against your 401(k) to pay off your vehicle or you can liquidate it with financial penalties. I would figure out what the financial penalties are and strike a deal.

Yeah, I feel that for sure. I push myself to give her everything I could, and change to be a better person. And for my efforts, she got a CPO and I got kicked out of the house and she’s out driving around in my truck right now. And I am stuck in a men’s shelter with no vehicle. And she’s already got a guy living up at the house.

You can do without a lawyer. The biggest thing is you need to document the important stuff like her moving out and you being the primary caregiver and then you need to make copies of everything to submit it to the court go to the clerk of the court for your civil court in your area, they are often very helpful with the forms that you’ll need to fill out. Also, make sure to fill out the appropriate forms with job and family or whoever you’re local assistant. This place is obviously it’s preferred…

There’s plenty of us that are in the same boat so don’t feel like you’re alone. women like to be apparently pretty nasty when it comes to divorce. you go from thinking that you were a special someone to being treated like you’re in a freaking POW camp. The more I step back from my marriage the more I realized how toxic and mean my wife was.

She is when she wants to be if that makes any sense. she actually took the time to write up the divorce agreement which was reasonably fair, but who knows how she’s gonna act when she finds out that the debts coming out of the equity of the house and then we’re splitting the rest. But obviously elephant in the room is how do I communicate with her and work through all this crap Get my stuff situated at the house. Not to mention I’m homeless.

No kids between us. We actually did really well on the house. We bought it for 86 and the county just appraised it at 220 and then I figure I wooded lot at least 30. total debt is about 60 between credit cards and truck loan and then she owes about 10 on her SUV. So I guess 70 altogether. I just have no idea how to navigate this
