So if you will look in my feed, you will notice that I posted that I had a pre-hearing conference today and I thought I would give you guys a rundown on what happened and some pointers for if you are going it alone without a lawyer. So to start off with, my county automatically includes a TRO of all the usual stuff that you’re not supposed to do after filing for divorce. She has since stop paying most of her bills and I filed contempt motions for those violations. There is also a CPO against me so I haven’t been able to get to the house Since being served with the CPO so I’ve been living out of a backpack worth of clothes at my apartment for about four months. Meanwhile, I have a house full of clothes and effects and such.

The big thing that I learned today is that when filing a motion, you need to request an oral hearing to have that motion ruled on by magistrate or judge.

This fact bit me in the butt today because she has control of the marital home and I’m still paying the mortgage. Had I known to file the motion a week ago for her to be ordered to pay the mortgage I would’ve.

In the plus side, the judge lightly slapped her on the wrist for not complying with my discovery request. And told her she needed to get that to me by Friday. I was also given a small reprieve in the form of being allowed to argue my motion for a walk-through of marital home in the contempt of court motion against her next week.

On a sidenote, she really didn’t like hearing that the house is worth a whole lot more than she tried to tell the courts. Poor thing.
