You should have already filed the contempt citation because the court process will take months. If she gets served and then flys right, you can always dismiss the contempt. No let OOAG handle it. You only pay a small application fee and they do the rest. Legally no. But it depends on whether you pursue child support. You do not have to be divorced to get child support from the non custodial parent. All you need to do is apply for Child Support Services from the State of Nebraska. I work for a Child Support Services office in Colorado. You have grounds to file a modification for both child support and maintenance. They are separate modifications. You only get retro changes from time of filing so the longer you wait, the more you stand to lose. DM me if you want more info. Slso keep in mind the due to Covid 19 Governor Polis has pretty much shut the State down. You can apply online but don't expect to go anywhere in person. Hope that helps.

Most states do not consider a temporary change enough to recalculate guidelines. Usually the change had to be "substantial and ongoing" if she filed for modification, file a response claiming that it is not substantial and ongoing. By the time it is scheduled to go to court this will be all over.

Try to use "ability to earn" at the 64k. You can claim that she is "voluntarily un/under employed". Have you considered in applying your local 4D child support Services office to do the modification? They have the ability to access Social Security and IRS records especially if she is 1099 employee. Other than that, PI is your only was to get "direct evidence" of earnings. I have worked for child support agency for 30 years. The court will allow "no child support" if both parties stipulate to it. As long asxthecissue is not contested, the court doesn't care but she can always ask for a modification after the fact. So ad long as you keep her happy, you should be ok.
