Austria allows a step-parent to adopt a child if the estranged parent consents or a court decides the parent is abusive or completely disinterested in the child.

He isnt disinterested as he has contact with his son.

They argue the father “failed to give a valid reason” for refusing to give up his parental rights so that the lesbian partner can replace him.

"No valid reasons" != Consent.

Wait for the decision from the court before getting worked up. You can't stop crazy people from being crazy, but you should be concerned when the courts violate your rights.

How is this by any stretch of the imagination discriminatory? From what I can tell, the result would be the exact same thing if it'd been a stepfather that wanted to adopt the child, not a stepmother.
