In short, yes.

You can find a surrogate and pay for her pregnancy, however the means of doing so varies.

My friend is paying his sister in law to be a surrogate for his and his husband's daughter. They did not use a fertilization program or purchase any donor eggs. All they did was pay for her to become really fertile, and pay to assure that an X sperm was more likely to reach the egg. They wrote up a contract basically saying that although biologically elated, this is not her child (had to be done), so that when the child was born she would not end up on the certificate. If you're lucky, you may have a relative, close friend, or come across a wonderful person who would be willing to offer her 9+ months for you. Now, the problem with this is that you need to make sure that she does not end up with the custody, which means making sure you hire a damn good attorney. Another thing to worry about is health issues. Best action, should you take this route, is to get a donor egg, since surrogate mother will not be related and have no claim to the child.

In most cases surrogates are hired through clinics, which can be expensive since you're not only paying for her needs, but the clinic as well. A surrogate can cost quite a bit alone, being that it is pregnancy, and then you have the eggs to purchase, which can vary depending on the donor. However, this route is usually the safest since your donors and surrogates go through all sorts of hoops in order to get where they are. They cannot claim that child.

In the U.S., you cannot "hire" a woman as a surrogate.

In some states, if you implant a fertilized egg into a surrogate mother (this egg cannot be hers) then caselaw supports that she has no right to motherhood of the child.

In Canada it's illegal to pay for sperm, eggs or hire a surrogate. You can still acquire sperm or eggs, so long as they're donated, or use a surrogate, so long as they don't get paid (nor does anyone else get paid to arrange for them to be your surrogate). http://en.wikipedia.org/wiki/Assisted_Human_Reproduction_Canada

Yes you can provided you have the cash*, I know because an ex-friend was born to a "womb donor." I mentioned it already over here.

*Dunno how much exactly, but this kid's dad was very rich so money was no object to him.

Is it possible to get around the legalities by having a child with a surrogate mother and then having her hand over total custody in court? I don't know anything about custody laws, so this could be an absolutely absurd thought.
