A burglar breaks into my home, beats me up, ties me up, possibly sexually assaults me or members of my family. He did a poor job of tying me though, so I escape, grab my gun and go find him. He is at this point not armed, and raises his hands above his head. I shoot straight to the chest, and kill him.

Now, do I walk because I could invoke self-defense? No, because self-defense can only be invoke with an immediate threat to your life.

been linked on /Oney for a while, just a crazy being crazy, Self-Defense is not Pre-emptive, Vigilantism. It is doing what is needed to preserve oneself in the heat of the moment.
