He should chat with a lawyer. And it sounds like he is going to get screwed.

Being a bipolar not taking her meds, he has half a chance to get primary custody if she can be shown to be a threat to the child.

Stuff like assault needs to be reported to the police (but not while he & she are in the same vicinity). If they are at the same location at the time of report, the police are more likely to lock him up.

He needs to start documenting her insanity now. He just really needs to talk to a lawyer.

My first reaction: Talk him out of this. He's insane to get married when he's got a newborn by another woman. And she'd be insane to marry him. After reading more, it looks like he's this baby's only chance, and let's just hope that wife #1 is good to him and the baby.

She physically attacked him. She cursed at him. Every other day there were threats about how if he didn't do X she wouldn't let him see the baby. She's unemployed, living with her parents, one of whom is also unemployed and the other of whom is a drug addict... it's all around a terrible situation.

After reading this, he needs to get the law involved, tell the judge about the abuse from the mother and the fact that she's bouncing on and off psych meds (which is far worse than just being on them reliably) and he must do everything he can (inside the bounds of the law) to get that baby away from her. Otherwise, that baby has no chance at all.

an insane mother is an unfit mother.

where she used to call upwards of 30+ times a day.

He can subpoena phone records, and he should, to show this obsessive behavior.

Get video, audio. Writing. Find out explicitly what the law allows you to do in your area to gather any evidence on her. Have him keep an explicit journal. DO ALL OF THIS.

It will be EXTREMELY useful in court. (where it is undoubtedly heading)

I went through damn near this exact senario. I didn't document enough, and the judge felt that the mother deserved a second chance. And once the primary parent was set, the court is extremely difficult to have any judgement overturned. Even our magistrate was baffled to the decision, but almost nothing can be done unless she really screws up now.

Always. Always. Get a paternity test. You can get one at Walgreens or any drug store for about $30 and have the test done for about $100. If it says you are not the father, for about $400 you can repeat the test legally (Results that stand up in court). I've had four children and I should have done it every time. Let my regrets be your lesson.

In modern times, when there is doubt it is correct 1/4 times that it is tested. That is an amazingly high percentage when it comes to paternity. When in doubt always, always test. Most state laws limit Paternity challenges to an insanely limited amount of time. Check your states laws.

step one, restraining order. step two, order for paternity test. if it's not his, then walk away... nothing more to do (hire a lawyer anyway, just in case). if it is his, keep restraining order, never talk to the kid or the mother. figure out how to minimize salary in order to minimize child support (being self-empoyed really helps with this). finally, move on, and stop fucking psycho girls.

EDIT: BTW, the time to deal with this was when she got knocked up, not when the kid's about to be born. he should NOT, under any circumstances, sign the birth certificate, since that is admitting paternity. unfortunately, depending on how involved he's been up to this point, he may not have any rights anymore. he'd better hope there's some other man in the picture who the judge can saddle with the responsibility. if not, like i said, minimize the cost, and NEVER ever deal with the mother or the kid ever again.

and WTF is he doing getting married now? so, he'll probably have to (i'm sure he'll choose to, judging from what i've heard here) deal with this psycho bitch the rest of his life, pay for the kid (and her to some extent), and now he's getting married to ANOTHER woman? sounds like your brother is just hell bent on giving all his money away to women!
