I don't think this will fly since she is already recorded making statements that there were intruders and they shot her husband. Of course, she will say that she was still scared at the time and that is why she made up the lie, but I think prosecutors will go for a first degree murder charge. An abusive husband story would also need to be backed up by injuries at the time of the murder. It is unlikely that she could have wrested the gun away from her husband, intent on killing her, without a scratch. She did not show any injuries at the time and probably doesn't now either. Compound this with the fact that, presumably, she was on the lam (and thus arrested on the warrant during a traffic stop). Her story does not hold water.

Just for the record, this doesn't show guilt or innocence in any way, all this shows is that saying you were abused is an easy way out of serious consequences. This is a bad thing because abuse is hard to prove now that the guy is dead, and abuse is such an emotional issue that it supersedes reasonable arguments.

The fact that a lawyer can say "Oh, but she was abused" as an excuse is sad. How many times does someone have to beat you before you have a right to kill that person ? I hope there is no answer for that question.

I hope that the best she will get is reduced jail time (if actual abuse has been established)

It's probably worth mentioning that the defendant here is entitled to the same standard of "reasonable doubt" as, say, a man accused of rape. If I were a juror, and the only information I had was the information from this article, I would acquit.

I liked the part where she claimed she wrestled the gun from her husband. The one that used to be an Olympic shot putter.

What new evidence do they have? Why did they wait so long to arrest her?
