I think the argument is that she didn't intend to set him on fire. She had a lit lighter that ignited him when he lunged at her, rather than her lunging at him with it and setting him on fire deliberately. I'm not condoning her actions and can imagine if genders were reversed the man would be in way more trouble, but I also think prosecutors sometimes push for lesser crimes (eg manslaughter over murder, GBH over attempted murder) as they are easier to prosecute as you don't have to prove intent.

Once people are over AA it's actually quite a good idea to only approach on IOIs, especially if you are good at forcing IOIs.
