I did! Both for alimony and child support.

My exwife became (and still is now) a chronically unemployable pill popper. She always has valid prescriptions. But they leave her in this gray fog, unable to focus. Not quite awake, not quite asleep. It's horrible when she gets behind the wheel.

Anyway, enough was enough and I filed for divorce after one too many disasters in the final 5 years of our 11 year marriage.

She demanded 50% of my take home pay in alimony because she's "too sick to work." And she wanted to get full custody of the kids too, for maximum child support $'s. And then she filled out the child support paperwork and put her income down as $0.

The judge didn't buy it, because in AZ, if you're a parent, you either work full time, or you are currently on disability. None of this, "Well, I filed for disability, and I'm waiting to hear back."

The judge put her deeded income down as minimum wage 40 hours a week. And she also denied my exwife alimony. Since I got 50/50 custody, my child support to her was a small pittance.

18 months post divorce, my ex was now flat broke. She needed money to pay for her DUI fines. The solution would be to get a job. She said, "that's crazy talk." So she (again) submitted Child support paperwork and put her income down as $0, which would have quadrupled my child support payment. I got notice of that and requested a hearing. Again the judge (same one as before) said "No. Minimum wage 40 hours per week."

Yes, in California it's permissible for the court to issue a seek work order or impute income usually at minimum wage.

It will be a drawn out process to get it up to 60k unless she has a long work history of her making that much. You're talking about an assessments and all that, so I would taper your expectations somewhat.

I would argue it's a safe bet to get it set at minimum wage, but higher than that is going to probably be more expensive than it's worth.

My soon to be ex wife can’t work a job because when she does she gets super stressed out and sad all the time and working genuinely upsets her and makes her not happy so she wants me to work pay her alimony and child support all while having no visitation rights and oh yeah wants to keep or sell my house. So that’s my story
