I had filed a complaint against Hackbright and Strayer for running this program that is clearly discriminatory. They often went out of their way to avoid saying that men are allowed to attend, a fact that OCR noticed as well. I filed in October 2021, and the resolution was formally issued today.

Specifically, the University provided data from the learning management system which indicates only three of the 1,207 students enrolled in the June 2019 through July 2022 cohorts preferred male pronouns.

While applicants do not provide their sex or gender in the application materials, the University discovered during its material collection in response to OCR’s investigation that its internal applicant and student database contains a field which auto-completes to “female."

Even though they didn't explicitly say "no men allowed" the evidence was compelling enough for OCR to force action.

The resolution leaves a lot to be desired and there didn't seem to be anything regarding remedy for past actions that have resulted in under-enrollment of males. I will be following their changes and filing additional complaints if I don't find them sufficient. I replied with an email about this, but I expect I will need to appeal:

This is not satisfactory. The Academy has historically had explicit discrimination against males. I see nothing in the resolution that indicates proactive steps being taken to overcome the effects of past discrimination that occurred prior to the University taking over operations, let alone the discrimination that continued occurring afterward. 34 CFR 106.4 clearly requires this after finding discrimination and non-compliance. It is entirely insufficient to just change language. The Academy and the University must be required to take additional steps to overcome the legacy of discrimination that clearly impacts representation of gender in current students. 0.25% of their students identified as male, and not a single person in their engineering program identified as male. They have very clearly failed to make any attempt at overcoming the legacy of discrimination after being taken over by Strayer, and this resolution does nothing to force remedial action.

Congratulations! I've read through most of your complaint and I admire your dedication, tenacity and attention to detail.

You have to close every hole if you want OCR to be forced to do anything and your energy in this regard is clearly effective.

The University will also be required to develop a training program within 60 days for Hackbright Academy staff, which will include statements that the University does not discriminate on the basis of sex in admission or enrollment,

If only we could harness the energy produced by all the eye-rolling in these meetings. If When you continue to be successful, it could even be a whole new energy source for the nation.
