STBX moved out in March 2020, leaving me with mortgage and associated bills to pay, while she lived with her parents. I sent voluntary child support until court order eventually came last September. Then after ~18 months of separate residences, we jointly sold the home and agreed to split the equity.
Should refunded escrow (tax/insurance) payments be shared as well?
I'd like to make a case that they should come to me (>$3k), as I was solely responsible for making all the payments, and any "overpayment" should be refunded to the payer.
Of course, checks have BOTH of our names on them; so i'd need her cooperation, and things are VERY touchy.
Is there a legal argument to be made here? Certainly passes the "feels right" test.
Thoughts?
