Heading to court March 30 for evidentiary hearing, with no stipulated agreement to date despite several mediation sessions.
We brought a motion in October asking for equal parenting time. It was strongly suggested we work towards 50/50 by judge, but language was vague and so far no agreement.
STBX knows I've structured my work around a 5/2/2/5. I need to be in-person most days.
I have a 65+ mile commute, but stay closer to work with my partner on nights I do not have kids, getting extra hours during those days.
Now STBX is "offering" 50/50 (which is amazing! but was likely imminent anyway)
Problem is she is now insisting on Friday exchanges w/ a Tuesday o/n during off weeks. This has never been suggested until now, and I feel it is only proposed to allay court and make things difficult for me.
Needing some input. Do I accept, and put this huge issue to bed, and deal with the challenges for next 10 years? Or chance pushing for what I feel is best and bring to court. STBX has been claiming all the b.s. around my being abusive, absent father etc etc. So not having to address this in court would save a lot of stress, but I am confident there is nothing that would stick!
Obviously, strongest case would be "best interest standard"
Any case studies, or reasoning here would be helpful.
Here's what I have:
5/2/2/5 results in 4x transitions per 14 day period
Weekly exchanges w/ a mid-week overnight is 6x transitions per 14 days.
Routine seems better as well, on 5/2/2/5. Seems easier for kids to have M/Tu, W/Th with same parent, then alternate weekends. Compared to every other week, w/ add'l swap of 1 overnight mid-week.
Our son had a recent IEP w/ school, and opposing lawyer suggested their proposal is in "best interest" because there would be "not so many changes". I'm certain she did not read IEP, and there are more transitions in her proposal anyway.
