I applaud that this man had to nerve to report it, even in a society where such abuse is often downplayed or met with mocking "lucky him" responses. I'm glad she was at least charged with something, and I really hope this man gets justice

The fact that it's been reported on several news sites is already a good thing, because at least more people can see that this kind of thing does happen

While I'm not a lawyer, I'm pretty sure that it's the oral part that makes this not rape, since the male and female sex organs have to be in contact for it to be considered rape. Someone please correct me if I'm wrong.

Like I said, I don’t know about New York law, but legal distinctions can exist for a multitude of reasons. Some exist for purely historical reasons, others because you want to reserve the most severe sanctions for the most severe cases, and because there needs to be precise definitions of where the bar is for when we decide to sanction something.

I mean, when feminists want to lump together a man saying “hi” to a woman on a bus stop as being the same as genuine cases of “sexual harassment”, you instinctively go “huh? that’s not the same!”

If it’s not rape, it does not necessarily make it legal, it is most likely be covered by a different subsection of the penal code.

I am a lawyer, and the answer to that question depends on your jurisdiction. I have no idea what the definition is in New York, but if it is of any interest, in my jurisdiction, you would be right: Rape is sexual intercourse through use of force or the threat of use of force where “sexual intercourse” is defined as the insertion of the penis into the vagina. It is gender neutral, so a woman can rape a man, but anal penetration, or penetration of the vagina with (other) objects would not be covered, and neither would oral sex. However, it is very important to realise that the fact that such acts are not “rape” does not make them legal, they would just be covered by a different subsection of the penal code, where “sexual intercourse” is just replaced by “other sexual contact”.

Dunno about where you are, but not true in the US. There only has to be penetration of some kind. Oral penetration is also rape, btw.

I am not a US lawyer, but I think strictly speaking that is a definition for statistical purposes, not a legal definition. US federal law does not use the term “rape” but talks of “sexual abuse” for non-consensual “sexual acts”. State law definitions may vary.

Well, I don’t have anything against male dolls for women as such. I just wasn’t sure if that was the point, that women would not commit such assault, if they had access to willing “subjects”.

I don’t mean this as any kind of moral statement, more as a matter of factly shrug of the shoulder: I think the vast majority of them already do, they are called “men”.

Nowadays, If you let someone get sexually assaulted and then the public finds out you let it happen...you are fucked. She wouldn't be able to sue after being the one committing the crime, he would just have to go report it right away.

Generally I don't care for the NY Post, but their reporting on this was on the money. They named the female perp while keeping the male victim anonymous--usually newspapers do the opposite--nor did they trivialize the crime. Progress.
