What arguments should I give to someone who says, "Having gender neutral rape laws will lead to men misusing it."?

I suggest they figure out that part before they worry about males misusing it

In order to consider this argument you need to also believe that this system exists.

It does not. What is true is that the world is made up of hierarchy, men are women are part of that but not inherently because of their gender.

If women want equality under the law with men, then that means neither party will be further scrutinized because of their gender.

Laws mostly around the world are patriarchal. Justice system also follows patriarchal way of dealing with issues. In such a situation, females do not get enough justice legally and socially.

The fact someone actually said this is insane, and immediately means they have zero credibility and should never be listened to in any capacity whatsoever.

It has been demonstrated on such an extensive level that women receive preferential treatment in the justice system that this conclusion is like claiming vaccines cause you to turn into alien xenomorphs which breath fire.

Seriously, how insane do you have to be to actually believe that women are the ones who do not get justice? We have family court, alimony, and laws which literally say men cannot be raped, despite some years official government sources demonstrating men are the primary victims of rape. On top of this women cannot be drafted, and there are countless government funded programs and benefits only for women and none or almost none for men. Further, when women experience a problem with crime it's a national emergency, yet despite the fact that men make up the super majority of victims, nobody cares about men, and never have.

The amount of justice men receive legally and socially is a rounding error. The amount of justice women receive in these areas is so far beyond the point of sanity that it is on the level of being a meme.

This entire premise is disgusting and horrible. What this person doesn't realize is that women complain about justice all the time because they are the ones who receive almost all of it. Men do not complain about it because they are so far beyond oppressed that almost nobody listens to them and nobody cares. Literally, as I cited, men receive six times more injustice than we've seen with racism.

Imagine how marginalized you have to be to have so few people care about your injustice that you can actually have the conclusion you don't have a problem in this area, when it's actually the greatest problem that there is by far. Imagine how privileged you have to be to be the primary and overwhelming beneficiary of justice, and still have people think you don't have enough to the point that men deserve to be raped without appropriate recourse for the victim as fair.

It's indescribable how obscene all this is.

I was actually looking for more information about the feminists who protested against India gender neutral rape law yesterday and I ended up founding a forum where Indian feminists were openly defending that rape laws shouldn’t be gender neutral. One of the arguments I remember is that “men would misuse it to harm women”, just like you say. Funny, right? The sacred female is incapable of lying in their own benefit against men when it comes to rape and a mere suggestion that women might take advantage of the system to do so cannot be tolerated. But men? It’s obvious that they’re going to use the law against women if they’re given the opportunity, after all, as much as feminists and their allies won’t acknowledge it, the good is female and the evil is male. That’s why patriarchy, the root of all evil, is named after men and feminism, the salvation, is named after women.

Well rape can be very hard to prove and can be the ultimate he said she said and isn't because of some patriarchal falacy.

You could point out that women get less jail time for the same offences to show that the law favours women.

You should ask him what patriarchal way is used by justice system and what is the alternate way? What would be the way in matriarchal system? Why does he believe that laws can be misused only by men?

This also needs evidence. What evidence does the person have? Can they find a single legal right men have that women don't?

you can tell them false accusation are only 2%(sarcasm) and do you really think false ones are more important than real ones.

but if u want to give them an actual argument then you can tell them that reporting for men would be extremely difficult and that's why it's highly unlikely they are gonna misuse it,to add they can add punishments for misuse of laws and that would make it better for victims on both side.

You could point out that the assumption of a patriarchal way of dealing with issues is laughable since women get more lenient sentences for the same crime than men.

With this fact in mind and his logic it goes without saying that laws should be biased against women (I am not for that, obviously).
