Just Be prepared. Have iron clad proof she abandoned the home to move in with affair partner. Meaning have dates( this is the day she moved out, told me this is her address this day wishing is this douche bag cheater. printed out texts and emails. Anything that paints her as a bad person. You never know what a judge is going to do. Have the evidence and your side. Also be very courteous to the judge. Say good morning judge. Thank you judge. Yes your honor, she is lying: . I have this text proving this is what she did and said on that date.

Might want to have the home assessed. You should have records on what the city has for value that they tax you on. Then have a list of extensive repairs that hurt the value of the home with photos. Lots of evidence.

It doesn’t hurt it’s ask the judge to let you keep the house because it’s under water and most states have a law that you cannot force a vet to get rid of there domicile. I would look into that.

Also state that you served etc into the statement as well.

we bought a home together

Is it a community property state? Did she contribute anything to the down payment? Utility bills? Insurance? Property taxes? Are the kids in school?

It's taken me 7 years.. mainly because my ex has been changing her mind on different assets. First it's okay, then not. - Pretty sure she did this since she's barely been able to work a FT job - and wouldn't have health insurance without being on mine, even though I have the kids primarily (like 85% of the time their with me) She's more the qualified has her MBA (I've only got my Bachelors)

I only had 1 hearing in the beginning where supposedly everything was agreed to. I let her take/have whatever she wants out of the house. Listen I get it, their's no equity.. But if you bought it and the "value" has gone up, you have to pay her half..

For ie, when my ex left it was a year after we'd just remortgaged after a renovation.. 0 equity. Like it was valued at 275K and went up by like 5K. in the year. subtract the 15k in credit debt she dumped on me and she'd have owed me money. She dragged it out for 7 years value has gone up to 400K.. I've been paying the whole time (owe 250K or so) ~ so her cut is technically around 70K after some taxes and stuff. To make it easier for me and the kids to stay here she's only taking 50K. But that's 50K when she should have owed me money. And has never paid a dime towards any child support.

So take everything and anything you can.. Make it easy and simple.. Ya want all the fine china take it, ya want all the wine glasses take 'em (honestly the kids don't need something more to break LOL) only things I argued a little about was the ex wanted to take the both big tables (I was like I need a table for the kids to eat and do school work at) And eventhough she took it anyway, the pots and pans. Yeah I came home our shared bedroom was empty my clothes on a pile in the corner. And several items of mine from before I met her gone. Truthfully you have things in life they come and go.

Kids their the gold. Ya fight for them and what you need to support them.
