Be sure to get a good lawyer. Many are bad lawyers but even more just run up your bills with bullshit. Big practices are the worst. Ask guys you know for referral.

Get as much documentation together as you can that she’s been gone and the kids have been with you. Keep it going forward if you don’t. But don’t tell her you are doing that. Talk to the lawyer about what to document.

A mother that would leave her children behind is trash. File for divorce asap, ask for full custody, do this before she has a change of heart.

Make sure you get your fair share of the assets.

She should be paying child support.

I would typically say make sure you get 50/50 custody, but your case sounds more like 100% custody.
