My exwife, after we were fully divorced, got remarried. But he left her after 6 months and filed for divorce. She went ahead and dodged the process server and refused to answer the door. So he filed a motion with the judge and they attempted "service by certified mail."

The postal carrier came there and her dad signed for the letter packet. She got served.

As Zyo said, once she is served, she has x number of days to respond. If she keeps ignoring the divorce and misses that deadline and doesn't respond, your case goes into default and the judge will divide assets and debts in half. She won't get a say in how it's divided. She will have forfeited her rights. I think the judge will split things based on what you want.

Stay calm. Don't ask her why she's being elusive. Don't show her proof. Don't talk about the divorce. Don't communicate with her. Keep serving her.

No. Just get her served, even if it takes ten attempts. They'll eventually get her. Or, you can get her served via "publication" if her dodge attempts keep going on. This happens all the time. Just be persistent and keep on your process server.

But no, she won't "get in trouble." In fact, it's likely nothing at all will happen -- because unless and until you have her served, the courts do not have personal jurisdiction over her. That is why you must serve "process," i.e. your petition and summons, which is due process, which then leads to personal and subject matter jurisdiction in the court.

Nope, not really. If she just dodged once, the court will be way more pissed at you for bothering them to tattletale than her for dodging. The answers are: (1) get a "more creative" process server or (2) file a motion for substituted service.
