If the Trust buys the house, it’s still considered part of the Trust and not subject to any claims against it. Ask your Trust attorney, there are more details.

+added. Whatever you do, make sure you do not use any personal funds as part of the purchase. An example would be paying for a bathroom remodel out of personal funds while the house is owned by the Trust. Keep Trust funds and personal funds 100% separate. Mixing in personal funds will definitely give your future ex wife a chance to make a claim.

I’m somewhat familiar, also with an inherited Trust. Anything in it cannot be touched by my then-STBX wife unless I removed it. My now ex thought she was entitled to half. Found out later she’s entitled to nothing. You’re welcome honey ..I.

You can buy the house, but living in it carries the risk of litigation as primary residence is usually considered community property
