She also could just be telling you its Tom when its a dozen other dudes. If your SMV was high enough she would drop this guy like a ton of bricks the first time you said don't text him.

She might not be sleeping with Tom, but she is cheating on an emotional level. Getting upset that he didn't say Happy Birthday signifies that she was making some sort of emotional investment in him and getting nothing in return. Your gut feeling is very telling. You can stick it out for a bit and see what happens or next her. If Tom really is "gone," how she responds to that will be interesting.
