Actually there's no implied consent in both states... Other than a narrow marital exception that is generally disappearing. Unconscious is basically always legal rape, relationship or not.

Some countries have removed rape from the statutes as a response to things like this and replaced it with varying degrees of sexual assault. We were going to have it in the UK as well, but the feminists decried it (RAPE IS RAPE!!!!oneeleven) and it was dropped, despite it being a huge step forward that would have actually made convictions for genuine sexual assault easier to get.

That aside, the law says lots of things, like this big fat joint I'm smoking is evil.

While I agree that the gravity of actual rape is greatly diminished by the word being thrown around so hastily, /r/sex would have gone apeshit on a guy for doing the same thing. I'd even go as far as to say that most people would point fingers at him.

Would I be angry if my ltr girlfriend did this to me? I'd be more worried of the implications of the sex (birth control?) than the act itself, but that doesn't eliminate the double standard here.

It depends on the way you have comments displayed. When I looked at the thread, the top displayed comment was something to the effect of, "That makes him a rapist", and all the replies were people agreeing.

The drugs do add another level to this, but it's worth noting that in OP's story, the boyfriend was passed out drunk, which can be equated to sleeping pills for all intents and purposes.

In my last major relationship I accidentally ended up doing this exact same thing. She was typically a light sleeper and this one morning I woke up a little hornier than normal, now typically neither of us were oppose to morning sex, but we had never discussed having sex while the other was asleep, or as a means to wake either one of us up.

Anyways the point of this story is that, as we were ending our relationship (she was leaving the Uni that I was at and not coming back) we talked about the best sex that either of us had had with the other, surprisingly she told me that this instance of me waking her up though sex was the best that we had ever had. This surprised me for a few reasons mainly being that she had never mentioned that she was asleep, and even after the initial deed she had not mentioned that she was asleep before the fact.

Tl;DR woke GF up with sex w/o knowing she was asleep, claimed it was the best sex we had ever had
