On the other hand, I know a woman who is seriously pissed off because she has to pay her husband alimony. She's in IT and makes good money, he installs appliances for a national retailer. He makes enough to support himself...... the alimony is somewhat vindictive.

Apparently, HE doesn't deserve a lifestyle to which he become accustomed...

Alimony is fine if you were a solid stay at home parent, but it is stupid to expect you can maintain the same lifestyle you had before. If you wanted to keep that lifestyle, you should stay married. Sooooo, this is why at fault divorce is so important. If a devoted wife of 25 years gets dumped because the husband wants a shiny new broad, I see no problem it raping the ever living shit out of his wallet. On the other hand, if a 10 year wife decides she needs another ride on the CC, she doesn't deserve diddly shit. Actions must have consistent consequences for there to be actual justice. Without actual justice, the whole thing falls apart.

The only excuse for alimony is in a fault based divorce system. I would allow it in 2 cases:

  1. The the filing spouse is the party on whom alimony will be assessed and they are divorcing the receiving party without grounds or fault

  2. The filing spouse would be the recipient of the alimony and can prove they are divorcing because of traditional grounds or fault of the party that will be paying

Under no circumstances should a party be able to get alimony for initiating a unilateral, no fault divorce

And why not? As a person with a background in law, can you explain why the current legal justification for no-fault is flawed?

Personally, I don't think you should have to wait until your partner cheats or hits you to exit a marraige. Why should government force you to stay if you've fallen out of love?

Since when does someone get damages for unilateral breach of contract?

Alimony is recompense for abandonment or breach of vows. There can be no justification for awarding alimony to someone who frivolously and unilaterally divorces "just because", can you think of one?

You shouldn't have to wait on anything to get the divorce you're right, I'm not trying to restrict unilateral no fault divorce. you should have to prove fault to get alimony, maybe you didn't understand what I said

In that case, the woman is restricted by her situation. Functionally speaking, very few women are main breadearners. And about 1/3 of mothers are stay-at-home.

These women would all be denied a chance to leave the marriage, because of no career prospects outside. Even though they spent their a good chunk of their lives enabling him to earn.

No one should force a person to stay but if a person cheats and then leaves and other person hasn't cheated the cheater should not get any alimony.

The way I see it is that if the stay at home person decides to leave then they should get enough alimony to get some education and then somewhat established, say 3 to 10 years depending on how long the marriage lasted.

I don't think that's what Atlas is saying. I think she's saying that you are free to leave at any time, but not free to collect alimony without justification.

Quick thoughts:

  • I'm fine with alimony. The "standard of living" argument makes enough sense to me.
  • A lot of problems come from lack of understanding of the system. Too much mixing of separate (pre-marital) property and community property, and from what I've seen a lot of problems come from this. Maybe laziness, lack of organization, or too much trust from the breadwinning spouse.
  • I don't think it should be close to 50/50. The non-working spouse needs to be incentivized to get back to work or remarry sooner than later. Plus, the working spouse is not getting anything from the spouse anymore. No more housework or sex.
  • I prefer American Rule states. Civil Law / Spanish Rule only makes some sense against multimillionaire+ people who've retired and get almost all their income from investments pre-marriage.

I agree with the top comment in that linked thread. I agreed with that even before one of my cousins frivorced without pursuing alimony aggressively enough and is now basically relying on me and my immediately family to carry her financially.

I'm in agreement with you. People think that pre-marital property will always stay separate, but that doesn't make any sense. If two people live in a house for their entire 20 year marriage, of course the judge is going to look at that. They're not idiots.

Regarding incentivization (I doubt that's a word, but whatever): A lot of courts have capped spousal support at a few years for this reason. Around here, you aren't getting spousal support without a marriage of over 10 years (they use a judge-created formula to figure out if it's worth it to award). Spousal support is to assist a person in integrating back into the world. It's not so they can sit on their ass eating bon-bons forever.

I live in California where there technically doesn't have to be a limit. It's at the court's discretion after 10 yrs, and has the potential to go on forever.

The point though really is to encourage them to start earlier. As it is now, the ex-spouse collecting alimony gets close to 50% after factoring in taxes and has no incentive to start working while he/she is still collecting alimony. He/She is actually encouraged to stay on his/her butt at home because if he/she starts working, then he/she is at risk for getting support cut. If he/she even remarries, then he/she is at risk for getting alimony cut.

The courts atm are incentivizing these people into staying dependent longer than they necessarily need to. Yes people need to be given time, but as it is now the marginal benefit of getting own income or remarrying is a lot lower because of this.

i don't believe in alimony. it literally defeats the narrative that women don't need men to be successful or stable in today's society. i don't think that because you were married for a time, you deserve his money once divorced.

if you want his/her money, stay married.

I think there should be a cap. I understand the argument of helping a spouse survive for a while if they spent years of their life helping the family instead of focusing on their career. But past a certain point it's just luxury money, you know? Alimony should help pay for a place to stay and a car. It doesn't need to help pay for a mansion and BMWs.

Although I'm sure that the vast majority of cases are reasonable and only the ridiculous settlements get attention.
