Elaborate on how you can't be divorce raped & hit with court-mandated child support.

[+]redpilltaste[S] -11 points-10 points-9 points 11 years ago (2 children) | Copy Link

Fair question. It is not where i wanted the focus though. I was hoping to tell people that I think the easy option for women to leave is a bigger part to failed relationships then I thought. I could be wrong. I really could be. Happy to be shown otherwise.

Reference the passive income pm me if you really want to know. I went through hell to get it and don't want to tell the world about it.

[–][deleted] 5 points6 points7 points 11 years ago (0 children) | Copy Link

You could describe it in general terms.

[–]errantcompass3 points4 points5 points 11 years ago (0 children) | Copy Link

Do tell me about this magical passive income

[–]TRP VanguardArchwinger7 points8 points9 points 11 years ago (6 children) | Copy Link

I don't know what bohemian paradise you live in, but in the states, any assets you can touch and any income, passive or not, is used to calculate your financial obligation to your ex wife. If you're living on X a month of "passive income," your support and alimony checks will be a sizeable percentage of X.

[–]trplurker 5 points5 points5 points 11 years ago [recovered] | Copy Link

Trust funds, foundation gifts and other assets the ultra wealthy use to avoid taxation.

The judge can't touch it for the same reason the government can't directly tax it, it's explicitly protected because those who use it contributed to politicians campaign funds.

A feminist judge could try order it but a good lawyer, the kinds that are hired by those with such resources, would get it tossed out in a higher court. This is how the ultra wealthy protect their income from juniors gold digging whore of a wife.

[–]TRP VanguardArchwinger2 points3 points4 points 11 years ago [recovered] (4 children) | Copy Link

A judge in the US couldn't make you give half of a fund/foundation that you don't actually own to an ex wife, true, but the amount of your support/alimony obligation would be based on the income you've been receiving from those sources.

[–]trplurker 0 points0 points0 points 11 years ago [recovered] | Copy Link

but the amount of your support/alimony obligation would be based on the income you've been receiving from those sources.

Not really, they can't treat it as gross or imputed income if the wife wasn't named a beneficiary. It's varies based on the state, which is why a specialized lawyer needs to be consulted on a case by case basis. The general rule is, if the trust and it's sole beneficiary were established prior to marriage then it's completely untouchable by the divorce courts. If Jimmy's parents set him up a very large trust fund when he was a kid, and it had a fixed dismemberment of $15K a month, then should Jimmy later get married and then subsequently divorced, that $15K can't be considered marital property nor imputed income nor gross income. This becomes ironclad should Jimmy get a pre-nup that specifically disqualifies her from anything related to the trust since certain states like CA / NY / NJ have passed laws that let them do legal tap dancing to reclassify the income.

This changes if the trust changes during the course of the marriage. If during the marriage Jimmy was stupid enough to name his wife, or lord help him the kids, as a beneficiary of the trust, then he's royally fucked. The ex-wife's lawyer will be able to argue that since she was a beneficiary during the marriage, then she should expect income from it. If it was the kids then Jimmy could very well find himself penniless as the Judge could move the whole trust into the kids name and remove him entirely.

There are a bunch of different types of trusts, each with slightly different nuances about how it can be legally manipulated. Remember really wealthy, resourceful and connected people got these laws passed to enable them to protect their wealth from their children's stupid mistakes. They are built precisely to protect from having the family's wealth transferred to an unscrupulous women in the case of divorce. It's about keeping the money in the family, not letting some bitch walk away with it. Which is why people need to speak to a specialist about this because of who deliberately archaic the rules are setup.

:Edit:

Ok got done reading even more about trusts and my head hurts like a mofo. It really depends on exactly how the trust was setup and what the settlor specified as instructions, it also depends on the state. In New Jersey for example, trusts and specifically exempt from marital property and from asset calculations but in Colorado there is case law that enables an ex-spouse to seek against the trust. If the trust was formed before the marriage by someone who isn't the beneficiary, then it's pretty easy to inoculate it from divorce rape as anything ordered from it would not be enforceable. Case law has already been established that while a court may make and order against a trust the court couldn't force the trust to disperse to a non-beneficiary, basically they can't garnish it like they do pay checks. Also if the trust has language that specifically excludes it from being used to pay spousal support / child support, then it can't be used as income for the purpose of calculation. It's all about the intent of the trustee when creating the trust.

So yeah if someone is going the trust route they need to do it before they get married, consult an expect and have language embedded that stipulates the trust is a fixed amount solely for the support of the beneficiary and specifically precludes the transfer of value to future spouse or children. Complicated as fuck but I see how and why wealthy people can use these to protect their money, foreign asset trusts and various variations of this basic setup would enable someone to ensure their millions stay within their family.

You're still ignoring CHILD SUPPORT. He has two kids. That can be factored into huge numbers when alimony doesn't apply. They'll examine his financial records, they'll see how much is transferred to his account, and it won't matter what the source is. It only matters that he gets it.

[–]trplurker -1 points-1 points-1 points 11 years ago [recovered] | Copy Link

You're still ignoring CHILD SUPPORT. He has two kids.

No I'm not, states have various laws regarding how trust income is calculated. New Jersey is the most interesting as they have a law on record that clearly states income from trusts are not to be considered as income for calculating alimony and child support in divorce proceedings.

I spent a very long time giving myself headaches to digest all that legal gymnastics. It's fucking amazing how well the ultra wealthy have managed to shield their income from gold digging bitch's their children might marry. It's possible to create a trust with the beneficiary being different then the person withdrawing from the account and other weird shit like that. I can put 50 million in a revokable discretionary account with the trustee being the family lawyer / wealth manager and the beneficiary being the financial adviser but with myself as the person having access to the dispersal account. The trustee, who has discretionary authority (absolute say so over the account) will then have a regular dispersal of 10~15K on a monthly basis. The result of this is that, on paper, I don't' get a dime of the money, yet in practice I get access to the money. The money is treated as a "gift" which isn't held as marital property nor can it be used as imputed income.

And that's just one way they can game the system. They got dozens more, and if we include foundations and other complex financial organizations it becomes millions.

[–]RedPillarOfSalt0 points1 point2 points 11 years ago [recovered] (0 children) | Copy Link

Again, you're talking theory, I'm talking from personal experience.

You're gonna have a hard time convincing any actual divorce victims about the reality of divorce with shit you read on a website.

If divorce law was that clear cut, we wouldn't have gone through the shit we have.

[–]DoesNotMatterAnymore2 points3 points4 points 11 years ago (0 children) | Copy Link

Sorry, i don't see your lesson. First you could at least hint how: "My wife knows that she cannot get any of my passive income." Maybe this tip would gave some meaning to you post. Other then this, it is a bragging post, which i divide by 2, since this is the internet.

[–]thenarrrowpath2 points3 points4 points 11 years ago (1 child) | Copy Link

How do you financially contribute to your biological children aside from "big ticket" items. Cloths and food are not big ticket, do you at least buy them new cloths and schools supplies?

[–]suloco1 point2 points3 points 11 years ago (1 child) | Copy Link

Your wife is not awesome. If all you write is true, she just behaves in her best interests. Should you expose your assets to possible divorce-rape, go soft or god-forbid, ill, she'll satisfy her needs before you can say 'hypergamy'. AWALT has no exceptions.

[–]redpilltaste[S] 1 point2 points3 points 11 years ago (0 children) | Copy Link

I actually agree. I think I may have not communicated it properly. Awalt applies to my wife entirely. The point I think I failed to make is that as she could not divorce rape me she was motivated to step up and not be typical lazy wife. I know if I get fat and lazy she will look for a better man. .. And I respect that.

[–]Lithiumthium1 point2 points3 points 11 years ago (1 child) | Copy Link

I think most are missing something very important here, the fact that his condition is the byproduct of his own effort to better oneself.

First of all I really liked that you said "my wife is awesome", it shows that you reached a balance, you aren't BP, you aren't RP, you are yourself, the result of your own efforts in all areas, and you reached the "main objective", which is being the owner of yourself, you know what to do if your wife turns "not-awesome" and you decide to break up, you will be sad, but you won't let it control you or any aspect of your life, for you what matters is not the blow, but how do you recover from it and your mindset of "well then, what next? I can handle it."

I do not fully agree with your opinion because thinking that my LTR is awesome will lead me to being accomodated, and I have a long road ahead before even thinking about "slowing down", my GF has flaws as any human being and AWALT in many things, but she excels most women in more ways than I can imagine, we defined our roles, we both workout, we have our jobs, and we haven't one single big argument in 3 years, hell even when we have a tough debate 5 minutes later we are watching MR. Robot or Homeland, she is great but she knows that she needs to keep up with me.

I think you had the same insight as me, being full RP is just as extreme as being full BP, therefore I will absorb the good from each philosophy and incorporate in my own life in a manner that pleases myself, not all of us want the "10 9/10HB per week" or lone wolf till 70, some of us want to have a good family and RP can help a lot with that too.

I really hope to reach your situation, I am not from the US so AFAIK the laws here are the same as yours, I got surprised because my LTR asked for complete separation of assets, whats mine is mine , whats hers is hers and if we have something that both bought we sell it.

Congratulations and I hope your wife is the one you will grow old with, but never forget to always keep improving yourself and reach new heights.

A very precise and accurate summary. I am sure whatever job you have you are excellent at it.
Best of luck in all things.

[–]2Sepean2 points3 points4 points 11 years ago* (10 children) | Copy Link

I'm on my first marriage, with 2 kids, and it seems I have it like you (sans the girlfriends on the side part).

The difference is that when we got married, I was rich, and I got a rock solid prenup. The financial crisis wiped me out, and now my wife is sitting on 95% of our assets and I can't touch it because of the prenup. She's also an ambitious girl that now makes more money than I do.

And even though she has zero economic benefit from staying, I still have it good. She's below 15% BF, horny and kinky, sweet and submissive. Of course she throws shit tests, but that's easy to pass.

Lessons Learned: It's the alpha that keeps your wife submissive and horny. Not some monetary prostitute-like cost-benefit analysis on her part

[–]RedPillarOfSalt-1 points0 points1 point 11 years ago (9 children) | Copy Link

rock solid prenup

No such thing.
https://www.youtube.com/watch?v=brznz2tif58

[–]2Sepean4 points5 points6 points 11 years ago (4 children) | Copy Link

I'm not in the US, thankfully. My prenup is indeed rock solid. I actually gave her better options than I could - I didn't want to "screw her over" completely, my main goal was to ensure that she couldn't fuck over my business, and I didn't see any reason why she should be left with an exorbitant amount of money.

[–]RedPillarOfSalt-1 points0 points1 point 11 years ago (3 children) | Copy Link

You should watch all of those vids. I can't speak for your country without knowing where you are, but I CAN say that every Western democracy I've seen has loopholes in divorce procedures that can circumvent a prenup.

You'll notice that the woman in that video also used the exact same term you did, "rock solid prenup" before describing how hers didn't work out.

If you're in Canada, UK, USA, Germany, France, Holland, Sweden, Iceland, Norway, Belgium, Denmark, or the Netherlands...your prenup is not rock solid, that much I know for certain.

Other countries, I can't say for sure.

Either way, you have serious oneitis and you're farrrrrr from Red Pill my friend.

In fact your original post is almost the definition of a Beta Bucks provider. She gets the good life handed to her on your dime and you think you're alpha because you cheat on her a few times a year?

[–]2Sepean2 points3 points4 points 11 years ago (2 children) | Copy Link

If my prenup isn't solid, I got some very bad legal advice, and their insurance would have covered my loss. Note that my prenup didn't say "she gets nothing", she would have gotten a comfortable lifestyle; it just got her significantly less than half.

Anyway, I got no real assets now, so it doesn't matter.

Either way, you have serious oneitis and you're farrrrrr from Red Pill my friend.

In fact your original post is almost the definition of a Beta Bucks provider. She gets the good life handed to her on your dime and you think you're alpha because you cheat on her a few times a year?

I'm not cheating on my wife so I think you got me confused with the OP.

I certainly don't have oneitis either. She ruined that fine with her behavior before I found TRP. Now that I found TRP I have everything I ever dreamed of, and the upside in spinning plates is just not worth it at all compared to the benefits to me and my kids from remaining a nuclear family.

If it wasn't for kids I get your point, but I want to see them every day, and I want them to be raised with a male role model that loves them in the home.

[–]redpilltaste[S] 2 points3 points4 points 11 years ago (0 children) | Copy Link

If it wasn't for kids I get your point, but I want to see them every day, and I want them to be raised with a male role model that loves them in the home.

You are a good man. Your kids will turn out wonderful with you there to help them.

[–]RedPillarOfSalt0 points1 point2 points 11 years ago (0 children) | Copy Link

My mistake, I did conflate your post with OPs.

Much respect for standing by your kids, I'm just encouraging you to evaluate the potential endgames appropriately. No prenup is rock solid, they're very helpful but not rock solid.

[–]trplurker 1 points1 points1 points 11 years ago [recovered] | Copy Link

Many such things if you live in the USA, though different states have different rules about it.

Get a fucking attorney to write it up, pay another attorney to look it over, then have your GF / wife / whatever pay their own attorney to look it over. Plan a signing day before you plan anything related to the wedding. Don't write anything related to kids or child support, just division of marital property, treatment of investments and alimony (she agrees to get none).

Those steps alone take out nearly every loophole imaginable. The last one is unconscious contract, meaning it's so lop sided that it would get thrown out if it was a business contract. You get around that one by not being a total dick and by having her sign a post-nup after every major financial change or every few years, whatever happens first. The post-nup reaffirms the conditions of the pre-nup and is a good time to add or remove anything that has since changed.

This shit isn't hard but it requires you assholes to stop having a victim mentality and just throwing your arms up and saying "woe is me, there is nothing I can do". There is always something we can do, we are fucking men and doing shit is what we do. There is even a method of last resort, which most of you are too pussy to even seriously consider.

[–]errantcompass0 points1 point2 points 11 years ago [recovered] (1 child) | Copy Link

What is the method of last resort?

[–]RedPillarOfSalt-1 points0 points1 point 11 years ago (0 children) | Copy Link

This shit isn't hard but it requires you assholes to stop having a victim mentality and just throwing your arms up and saying "woe is me, there is nothing I can do". There is always something we can do

Yes, and I did it for 5 fucking years. And no, I'm not going to murder people because of my divorce, so quit your childish hinting at that in every other post. Yes, we all know, we could kill our wives instead of divorcing them. You think we didn't think of that in the course of our lives being destroyed by a biased court system despite the wording of the law?? You think that never crossed out mind??

The day you kill a woman because of a divorce is the day she wins. You just don't get that yet.

But go ahead, Mr. Expert, tell those of us who have been through this more about our personal experience because of what you're read on the internet.

So basically, tl;dr "AWALT, but not my perfect female!"

The oneitis is strong in this one.

"With me she has the easiest life out of any of her peer group. We have holidays for up to two months at a time, can have a big house"

THIS is EXACTLY how she'll rape you in the divorce. You've "made her accustomed to a certain lifestyle" as her divorce attorney will say. "She'll have to help the children transition too" they'll say. "She and the children need that big house more than a newly divorced single dad".

You're almost certainly wrong that you have ANY type of income that can't possibly be taken in a divorce, but more importantly you're blindly ignoring your house, car, child support etc that she will take if she leaves.

You keep saying she knows she can't take your money, but you never explain why you think that is. I highly doubt you're accurate about that. I assume you're thinking that passive income means no wages to garnish...but you're not accounting for the child support checks you'll be writing with whatever income you have.

If you were wise you would drop the oneitis, quit thinking you have the system beat, and start working to protect yourself against the very real possibility of divorce rape you're blind to.

"I am the most alpha of all of her girlfriends partners/husbands"

Delusions of a blue pill beta who thinks he's a special alpha snowflake...

[–]redpilltaste[S] 3 points4 points5 points 11 years ago (2 children) | Copy Link

You are wrong. I don't "think" she cannot take my wages. I don't have any wages. I have passive income that no one can touch. Read the post properly. Oneitis? She is the mother of my two boys. I will have her in my house being mother to my children.

"You're almost certainly wrong that you have ANY type of income that can't possibly be taken in a divorce" I am glad for you that your statement left room for me to be right about untouchable income, because it is what i am on. Call me a bluepiller... sure buddy whatever you say.

[–]RedPillarOfSalt0 points1 point2 points 11 years ago* (1 child) | Copy Link

Any income or assets will be considered if you are ordered to pay child support. Period. That child support calculation can easily include house and car payments for mom's new house and car. It can include extra money to maintain those vacations that mom and kids are so used to taking. It can include extra money for mom's living expenses as she has no job.

You can go on boasting how you have the system beat, but nothing in your life is safe from child support. Yes, a few incomes cannot be GARNISHED, and a few won't be able to be applied towards ALIMONY, but CHILD SUPPORT is unavoidable and will be made larger by all of those factors I've stated.

You're blue pill if you cannot accept the red pill truths backed by overwhelming evidence from millions of divorce raped men before you.

And yes. Oneitis. You have it. "She is Awesome" =/= "AWALT"

Go ahead...name your untouchable income type. Show me traceable income that can't be factored into anything.

Now that I know you're in the UK I can guarantee that you're wrong. ANY incomes, from ANY source, passive or not, will be factored into your child support payments. Period. Trust funds, custodial investment interest, overseas investments, etc. As soon as that money goes through ANY paper/digital trail (and it is unless you are physically carrying cash on airplanes into your country) it becomes subject to child support factoring. That's how it works in the UK. Period.

[–]redpilltaste[S] 0 points1 point2 points 11 years ago (0 children) | Copy Link

Wasn't boasting. I have been on this payment for 11 years now. I am very used to it. The point I was trying to make was about how the current child support laws negatively affect female behaviour. You are simply wrong about nothing being safe from child support.

On a very serious note. Do your own primary research about the law you need to know about. Go strait to the act/legislation and read it yourself.

Solipsism: the view or theory that the self is all that can be known to exist.

I think that you don't know what laws exist because of this.

You incorrectly extrapolate. You say you KNOW I am in the UK??? Because I was born in Wales? You see where you went wrong there. Stop jumping to conclusions mate.

I do wish you all the best as it seems you have been hit by child support hard. If it makes you feel any better I was hit hard in my first divorce. Lost two homes which were mortgage free. Had to start again.

Take care and look after yourself (serious).

[–]trplurker 1 points1 points1 points 11 years ago [recovered] | Copy Link

Not that I agree with what he wrote, but there are certain income categories that are out of reach of a court. For one trust funds can't be touched, and possibly some overseas investments depending on their location. Income from a foundation or other custodial investment would also be out of reach of a court. Basically anywhere a wealthy person would put money to avoid taxation is also immune to divorce court judgements.

OP does sound like a trust fund baby though, that alone would explain a lot about his lifestyle. Judges could try to order stuff from that but there is no way they could actually get it executed, especially since with that kind of financial backing he could afford a good attorney.

[–]redpilltaste[S] -1 points0 points1 point 11 years ago [recovered] (2 children) | Copy Link

WTF How the F*** did you get trust fund baby out of me!!! Holy shit!! That just blew me away! God no, born dirt poor in Wales to a dirt poor family matey.

Your first paragraph is great though. There is always a way. People get so caught up in listening to other people about what is law and not. I suggest that everyone researches their circumstances themselves. In that confucian sense that man of the house should know enough medicine to help their family. I believe that every man should know enough law to help himself. I have helped my circumstances by reading the law repeatedly until i understood it (I did not finished high school, but did go to uni years later).

[–]trplurker 2 points2 points2 points 11 years ago [recovered] | Copy Link

Any asset that is in your name, managed and owned by you can be used in a judgement against you by a court judge in the USA. I'm not sure what the rules are in the UK, but seeing as London is one of the worst places to get a divorce, it can't be much different.

The wealthy protect their money by putting it in various trusts, foundations or overseas investments / companies and then having the returns / dividends / disbursements routed to an account they control but with a fixed amount being removable. They make it extraordinarily difficulty for anyone, including themselves, to remove the principal. This also makes it difficult for the government to touch the principle, which includes judges who are part of the government.

Anyhow, if your passive income is directly in your name via UK based investments, then the judge will likely be able to order her a part of that as a marital asset or you to pay her part of it via maintenance or child support.

[–]RedPillarOfSalt-1 points0 points1 point 11 years ago* [recovered] (0 children) | Copy Link

THIS is correct, though I would add that any traceable (paper/digital trail) incomes from any source will be factored into the child support and maintenance calculations as well.

Unless OP is carrying stacks of cash into the country without declaring it, his passive income is going through banks under his name. That will be found and factored for child support.

[–]RedPillarOfSalt-1 points0 points1 point 11 years ago (3 children) | Copy Link

No income is safe from child support, and child support can be inflated many ways to include monies for a new house, car, etc for mommy when she cannot take it with alimony.

No it's not, stop with the "woe is me, we're all fucked" victim mentality.

Do you honestly thing wealthy families sitting on billions of USD worth of assets would risk even 1/10th of juniors piece going to Ms SlutALot?

Your entire mentality is form someone who's only concept of "money" is a routine deposit in some checking account. The wealthy don't use money that way, it's inefficient and how you get poor. True wealth is locked away in such arrangements that the US government can't get it, which means the judges can't get it either.

If you stop with the victim complex and read, word for word, what I wrote, without putting your words or interpretations on it, then you'll see how to do this. Families pay wealth managers and high end accountants a shit ton of money to make damn sure that their wealth is protected from sluts-gone-wild giving junior the golden pussy.

You see a slut winning a few million from a wealthy family in a settlement with some big (to you) maintenance, but what you don't understand is that's nothing compared to what wealth they did have access to. They couldn't leave her with 0 as that would just invite too many other legal questions, so instead they either offer a number up front or doing the discovery process allow some stuff to be found while ensuring the lions share is safely out of reach. You get offended when you see such large numbers, then swear off women. What you don't realize is that she would of won 10~20x more if it had been you because you lack the knowledge of how that shit works.

Anyhow, and this goes to all three of your replies, educate yourself and break out of the victim complex you've built. You are not a victim, you have power and you can game and exploit the system just as much as her. In fact you can exploit it more because your not restricted to emotional logic and thinking patterns.

I've been through it chief. You're talking about your little theory. I'm talking about my personal experience.

Tell me more about it when you have a divorce attorney on speed dial.

Educate myself? I did, for 5 years, with the help of 3 divorce attorneys.

Now you can educate YOURSELF about the stupid shit you just said about billionaires in divorce: https://en.wikipedia.org/wiki/List_of_most_expensive_divorces

You are not a victim

Actually, I AM a victim of gender bias discrimination in divorce courts.

Break out of your "I'm an expert on divorce law even though I've never been married" mentality, child.

So...you're financially and emotionally abusing her because she has no other options is what you're saying?

No it is not what I am saying. If that theme is what you drew from the post then enjoy the outrage that you want to feel. She can leave and work for herself and we can share care of the kids. But she earns her own money..just like all the men out there.

This is a loveless marriage. She's only with you because of your money and the lifestyle it enables, and she would take you to the cleaners in a split second if only she had the opportunity. You're with her because... well, why are you? Because you thought you had to fulfill some nebulous social obligation?

If you have to get a prenup or come up with some clever scheme to protect your assets, you've lost the game. If you don't trust someone to not take all your shit, you should not marry her.
