Yes they should serve jail time. As much as a rape charge would get. False accusations ruin many lives, not just the target. Obviously that goes both ways.

Also, I think any person wrongly accused should seek civil penalties from the accuser, their school or work etc, if they lose their position, scholarship, etc.

Innocent until proven guilty is fundamental.

I think there needs to be a time limit as well, unless the victim was a child and the accused was an adult when it occurred. If you don't report the crime within 1-3 years, too bad you lost your chance!

Prosecutors have a policy of usually not prosecuting, as it discourages actual victims from coming forward (they claim).

If you accuse someone falsely of a crime you should be convicted for exactly that crime, including all the consequences as if intended.

There was a post before where a mother and a son committed suicide because the son was falsely accused. So the consequence of the false accusation was the death of two people and it has to be taken as intentional. So the false accuser should be convicted of rape and double homicide.

Yes but the difficulty is in finding evidence to prove she lied and that the lie was on purpose and malicious. It should be a 5-10 year sentence. I am not willing to throw out evidentiary requirements so it won't be possible to just go after any woman who loses her prosecution of a man, there would need to be hard proof like a confession or a vid of her admitting to the lie.

God damn right I think they should serve jail time, they can ruin someones life with an accusation, just like a real rape can ruin a woman's life, seems to me the punishment should be similar. I have never understood this thought process of taking it "easier" on women who are constantly telling us that they are equal, if they are equal then they can suffer the consequences of their actions the same way we do.

We would have to be just as careful about "innocent until proven guilty" in the other direction. The difficulty is that rape is often hard to prove. So just because a rape isn't proven does not mean a false accusation has been proven. If we are to hold to this guiding principle, alas, unproven guilty people get away with it from both directions. It is the cost of a just system.

Instead of serving jail time, I want every penny taken from her savings and possibly even her retirement. I want her to continue living in the community, only much poorer. She will become a drag on everyone in her life if they choose to support her, and the whole town will have to be reminded, every time they see her, of what kind of trouble she brings. And I want her to absorb this social nightmare, wearing Goodwill clothes while balancing her food stamps in front of the obese mother, who is buying boxes of wine and cheetos for the kids.

If a woman serves jail time, she becomes a martyr (see Donna Hylton). What is most precious to her are her social privileges for being a woman. Let's downgrade her standing.

First time offense: punishment equal to filing any other false police report. This doesn't factor in the additional crimes of fabricating or falsifying evidence, which should be charged as their own crimes.

Filling false reports with police is already illegal and should be prosecuted accordingly. Any false accusation the results in prison time for the accused should have the full sentance re-assigned to the accuser. The false accuser should also be subject to civil suits.

Actual victims would fear to go to police report it and men that should be put in jail will keep commiting it.

They should create a public website showing people's ID so everyone knows forever what that person is capable of. I don't think it's too extreme because the rape accusation itself destroys a man's life forever, the news are on the internet and everybody will know forever that he was accused of that once, even if it's false, so it's fair to destroy hers forever too.

But I doubt it will happen. Probably not.

Because young women are considered valuable (they hold all the reporductive power), and important for the future. Thus they need to be protected, favoured, etc.. in all possible ways.
And because men ar disposable reporductive speaking, they only have value when it comes to protection and survival. But these 2 things are takes for granted now pretty much, because the life that is created in the western world is quite comfortable for survival. And there are no current wars/fights going on, so protection is aso comfortable atm.

If it you can prove in court that the person manufactured it completely when they lied to police, committed perjury, and/or defamed someone through slander/liable it should be the same sentencing guidelines for the crime they falsely accused someone for. If it is just a instance of mis-identification, where a rape did take place (like if a woman is raped and brutally stabbed) and the police just rounds up a random black men and then gives him a sham trial. That is on the police not the victim.

That really depends on how you define "false rape accusation." If you're talking about a person who knowingly lies to police, then they can be punished under false report laws. They should be punished with whatever that crime's sentence carries, and then any other damages should be fought for by the accused in civil court. Many want to say that making an accusation that doesnt end in a criminal conviction is a false accusation, which is just not true. For example, Dr. Ford believes that Kavanaugh assaulted her, thus any reporting she does would not be a false accusation.

On one hand, if you make the punishment too severe, no woman would ever admit she lied. On the other, society needs justice to continue. So, I think juries should refuse to convict the falsely accused of getting in a little extrajudicial justice. Most won't take this option because men are actually the merciful sex. But, every so often, a burned down house or a broken leg would act as a deterrent.
