Something similar happened to my cousin. Inherited his parent's home. Meets her. Marries her. Moves her in. Has 2 kids.
She convinces him to sell the house and buy a new house. Two months after the new house is purchased, she tells him she doesn't love him anymore and kicks him out of the house. I don't know all the details but he lost all his hair shortly after that.
sad story.
[–][deleted] 35 points36 points37 points (20 children) | Copy Link
What you described I've actually witnessed several times in the divorce industry... I've worked for two different twice-divorced divorce lawyers.
Making a big stink about wanting a new house is actually their way of converting separate property into divisible property. The general rule is that property acquires before marriage is not divisible. Meaning if he held onto the house he inherited, then marries her, she gets nothing. However upon marrying, selling the house and buying a new house (in some jurisdictions) makes the new house divisible because it was purchased during the marriage.
[–]DWShimoda17 points18 points19 points (11 children) | Copy Link
BINGO.
Also by the by, in an equal and similarly perverse fashion, (in many jurisdictions) even when the guy THINKS he's being "smart/savvy/shrewd" in NOT using the funds from the prior home as equity to pay for/into the new one (instead sticking it into some paper/market investment, etc), or even if he does the sale BEFORE "legally" marrying her (but concurrent or after purchasing the new home WITH the woman, i.e. prior to legal/formal marriage)... doesn't matter.
Why? Because since the SALE of the old/prior home takes place DURING the "relationship" (and particularly if/when AFTER the buying of a "new" home together --which lets face it the purchase of the "new" home nearly ALWAYS precedes the sale of the old one; and waaaay too many idiot men "comingle their finances" and/or buy a house WITH a girlfriend/fiancee, that is with both of their names on the title/deed, even prior to marriage) -- then that means the PROCEEDS of the sale will likely be deemed "fruits of the relationship"; IOW marital/divisible property.
And of course, even if the guy was REALLY "savvy" and both avoids any/all "comingling" of finances/assets, AND he has a properly crafted/properly executed "prenuptial" agreement...
All she really has to do is pop out a kid, and -- like saying "abracadabra" -- all of his assets (essentially) then become "family" assets... she might not be able to grab 50% of it in divorce, but she can likely establish a sort of "lien" against it via "lifestyle child support."

i think im actually going to start a new thread on the front page called "dirty divorce tactics" and just put down a few things that i've learned. some of us are literally a blow job away from going back to the plantation, and if so, i'd like for them to be armed with knowledge about the system.
[–]teslaistheshit4 points5 points6 points (0 children) | Copy Link
There was a show "Divorce Wars" https://www.cnbc.com/divorce-wars/
I think every dude should be FORCED to watch that prior to their engagement.
[–]DWShimoda2 points3 points4 points (0 children) | Copy Link
It really IS amazing just how many SMART guys (and we're talking otherwise VERY "shrewd/savvy" dealmakers, etc -- the kind of you have to get up pretty damned early if you wanna "put one over" on them)...
Nevertheless fall RIGHT SMACK DAB into the "I'm not saying we have to get married... I'm perfectly happy for us to just 'live together' I don't need that piece of paper to show how much I loooove you ... but sweetie pie, we SHOULD buy a different house... together." tricksy/trap.
Damned fools.
BTW this just (literally) happened a with a very "successful" (worldly wealth terms) friend of mine. He got divorced & divorce-raped about a decade ago (barely survived emotionally & psychologically), but put himself back together, went "back to work/business" and MORE than recovered... bought some multi-million dollar (ridiculously massive) "mansion" thing. Then he met... well let's just call her "Obviously gold Digging Bimbo #2" (OgDB II) -- and in fairly short order, OgDBII "plugged herself in" to the house & wallet (i.e. she and her crotch-spawn moved into his "mansion"because... BIG house, lonely guy, LOTS of extra room, "womanly touch" for decorating, party-hosting, etc {whereas his personal tastes... YIKES!})... and then she began the process of "wheedling" him.
Took a couple of years, but with the assistance of a "natural disaster" that caused some minor (but inconvenient) damage to the "mansion"... well guess what? Of course: Buy and move into mansion #2 (while mansion #1 is being fixed/refurbed for sale). And oh, well hell... she wants HER name on the property too, so OK. Less than a year later (last winter) she got him to "marry" her... of course a "destination wedding thing" (IIRC someplace in the Caribbean).
I guarantee you the "clock" is ticking on THAT time-bomb of a marriage... she has systematically laid ALL of the groundwork to be able to thoroughly divorce-rape his ass (10x worse than the last one); I fear he likely WON'T survive this one (emotionally & psychologically) and he sure as hell doesn't see it coming.
But of course NO ONE can actually warn him about that -- he would never even listen to anyone who tried -- besides, it's too late now.
Oh did I mention that OgDB II is already twice divorced previously? Ayah.
[–][deleted] 2 points3 points4 points (1 child) | Copy Link
Wow always knew marriage was a shit idea but still! It’s a guaranteed lose, you’d have to be mad to marry
[–]DWShimoda1 point2 points3 points (0 children) | Copy Link
IMO, most men who marry really aren't "in their right mind" -- to use an archaic term, they're "besotted" (i.e. "drunk") -- not perhaps on wine, or liquor or other drugs... but on hormones, pheromones & the internally generated brain endorphins of "love & lust" (some of which are arguably much more powerful, affecting & addictive than Heroin).
[–]teslaistheshit2 points3 points4 points (3 children) | Copy Link
Ugh that's tough but very much important for anyone to read. Doesn't matter who contributes the bulk of the fruits nor does it matter the sacrifice. Prior to my divorce our marriage counselor tole me "you can't keep score". So, fuck that. Marriage is punitive if you do all the work.
[–]DWShimoda1 point2 points3 points (2 children) | Copy Link
It is "tough to read" -- especially that judges have been known to "back date" even years prior to a formal/legal marriage -- and for guys who THOUGHT they were being "shrewd" by delaying the formal marriage.
But to be blunt about it, the cases where that happens the guys have generally "screwed themselves"... because they typically had a de facto "marriage" arrangement with the girlfriend (and often "fiancee"; and even "baby momma" to their "baby daddy"), comingling finances, and either having both names (and using both salaries/credit histories) on some home mortgage/title or apartment lease. IOW basically presenting themselves to the world AS IF they were (what used to be called a "common law") couple -- and for all PRACTICAL intents and purposes (just minus the "piece of paper") factually shacking up & living together as husband & wife.
In those kinds of cohabit/LTR situations, you really can't fault the court/judge for following the line of reasoning that goes: "You may have only had the 'wedding' a year ago, but the kid you had together is already 6 years old... you've owned a house together for 3 years, co-leased an apartment for 5 years before that, and you've been 'playing house' as if you were married for well over a decade."
Because factually, the "wedding" really WAS "just a [superficial/irrelvant] piece of paper."
[–]JeffreyGein 0 points1 point2 points (1 child) | Copy Link
Yeah and the next thing you know, you have crossed the 10 year point (lifetime alimony in California).
Bend over.
[–]teslaistheshit0 points1 point2 points (0 children) | Copy Link
OMFG. 10 years is alimony in Florida then 17 for permanent. Alimony is debt prison IMO and needs to be abolished.
[–]JeffreyGein 1 point2 points3 points (1 child) | Copy Link
Yeah, I had some mutual funds I owned prior to getting married. I cashed out and switched investment firms, bought the same class of mutual funds at the new firm. Because I sold and rebought during the marriage it turns into community property. Total bullshit.
[–]DWShimoda1 point2 points3 points (0 children) | Copy Link
Worse irony is had you stayed with the same firm, kept the same account and simply sold/rebought from one fund to another (without any cashout), it may not have triggered the definition change.
I've heard differing things about a guy "refinancing" a home; in one instance (apparently because by staying with the same lender no title search or refile was needed) it somehow was still considered a pre-marital asset; another friend though did a refinance thing (different lender, so title search and mortgager lien change) and the home DID get declared a "marital asset."
But those were also several years apart, in different states/court systems, and of course different judges -- so while I'm inclined to this it was the title date-change, it's really difficult to say with any certainty what or why the houses were classed differently... who knows, it could even have just been the arbitrary "whim" of the judge.
Regardless... it does show that the whole "marital property" thing is just a frigging landmine (and what any attorney tells you on any given date/year... may or may not end up being the way it works out... it's a crapshoot at best).
Answer is of course... don't marry, and don't cohabit. (Or if you do, know that if/when a "divorce" happens, as the man/male you're HIGHLY likely to get screwed.)
[–]crawlwalkruuu3 points4 points5 points (7 children) | Copy Link
Wow this might explain why my dad was freaking the fuck out when i was a kid and my mom was trying to get him to get a new house... never made sense at the time "why wouldnt he want a nice newer house in a better area?"
Luckilly my mom is a good person and she actually did just want a newer better house and things worked out well lol.
[–]DWShimoda0 points1 point2 points (6 children) | Copy Link
Yeah gee, why WOULDN'T he want to go even DEEPER in debt? And buy a house that probably (almost certainly) has even HIGHER property taxes.
Especially if he had finally "turned the corner" on the previous mortgage (i.e. THIS Graph -- showing the point where you're finally beginning to really accumulate "equity", that is where MORE of your monthly mortgage payment is going pay down the balance, rather than most of it going to "interest" -- but of course the "twelve year" is a YMMV kind of thing, on a standard 30 year "fixed rate" mortgage that point could be anywhere from year 10 to year 20, depending on the interest rate, downpayment amount etc).
See he probably WAS able to see the proverbial "light at the end of the tunnel" (i.e. in another decade or so, I could quit working tons of overtime, etc... maybe even be able to pay the place off & retire.)
But noooo... granite countertops (!) and new oversized kitchen (with an "island" and commercial-grade/sized appliances, etc) -- all of which equals -- another DECADE (or two) of wage-slave status.
Yeah, why wouldn't any guy want that? (Heck she MIGHT even let him rig up some "man cave" in a corner of the basement... or maybe out in the garage! W00T!)
[–]crawlwalkruuu-1 points0 points1 point (5 children) | Copy Link
Actually they did come out ahead. this was juuust pre 2008 where they made money on the old house and the new house came out about the same and with the bit of surplus managed to pay down the credit cards. Actually the only thing they got fucked by was our builder. The guy took for ever and because we werent able to move out of the old house faster, it cost us a lot as the market fell. Basically upgraded for free.
[–]DWShimoda-1 points0 points1 point (4 children) | Copy Link
Highly doubtful.
One of the most common mistakes people make is looking only at the "upfront" costs; rather than the "lifetime costs."
To wit: you "upgrade" to a "newer" house; and probably to a "larger" one in a "better neighborhood"... and:
Yes, your "short term" maintenance costs may seem to go down (because, DUH! brand "new" home, likely all new main "utility room" appliances {furnace, water heater, etc}, most likely entirely new "kitchen" appliances {stove, oven, fridge, microwave}, probably even all new furniture, as well as new flooring/carpeting; and even things like all new faucets, lighting fixtures, etc.)-- which results in a "See honey, look at all the things we WON'T have to worry about -- much less repair or replace -- for a decade or more!"
Problem with the above of course is that the initial outlay is MUCH higher (basically a full decade+ worth of repair & replace costs is now upfront) -- and it doesn't prevent repair & replacement costs...it just pushes them out a decade (arguably worse, it creates a "false" sense of NOT having to repair/replace... generally leads to MAJOR budgeting problems a decade later).
Because house is not only newer (and likely priced/valued higher), but also is almost certainly LARGER; a bunch of recurring/annual costs -- insurance, utilities, property taxes -- will likely be significantly larger (higher) as well.
Similarly... and as a sort of double-negative effect, changes are the "upgrade/upscale" was also to a trendier/more fashionable (you could even say "higher class") neighborhood... and most of those have even HIGHER property tax burdens.
So, no I rather sincerely doubt that their overall housing costs was anything like a "free" upgrade.
[–]crawlwalkruuu-1 points0 points1 point (3 children) | Copy Link
Wow you can go fuck yourself with your smug attitude.
Bought old house for 40k Had house sold at high before market fell out at 200.
Built new house for 200 but didnt obviously pay for it all in cash up front. Kept a large portion on payments and used leftover money to pay off credit cards at a higher interest rate.
"BUT AHHHH HAAAA I CAN MATHS AND THAT ISNT EXACTLY WHAT YOU SAIIID"
I condensed because it is still a far better deal covers the basic synopsis and i didnt feel like typing out a full story. So yeah, go fuck yourself.
[–]DWShimoda0 points1 point2 points (2 children) | Copy Link
Some people "Win" the lottery too.
Doesn't change the fact that the Lottery is essentially a "tax" on idiots who can't do math.
That's not being "smug" it's being REALISTIC.
Also rather interesting how your story has changed SO dramatically... went from being about how your parents "upgraded for free"... to suddenly being about how you got lucky (that one time) with some house "flip."
*Yawn*

[–]DWShimoda0 points1 point2 points (2 children) | Copy Link
Don't be to sure of that.
Men HAVE been sued AND forced to pay "child support" in certain jurisdictions based upon the "finding of fact" by a court that -- by allowing them to live "rent free" within his home, feeding & clothing them, treating them as if they were his children -- that the men HAD "taken on parental financial responsibility for the children" even though they had NOT formally/legally adopted them, nor formally/legally married their mother.

Noticed this a lot. Omg he's never there for me... Yet she never helps around the house or cooks while he does, doesn't work as hard or at all etc. Like, if you want to spend more time together, wouldn't you actually want to help with those things? Instead of just complaining? But they just like to have a reason to complain about him, if she actually helped and they had time, she could've only blamed herself and ofc she couldn't have taken that responsibility.

Doesn't work.
He'll have to "develop a 'gambling' problem" (even better if it is accompany by a [wink wink] "drinking/drug problem") Withdraw big chunks of money -- cash that is -- go to Vegas (and/or other casinos), and claim to have "lost it all"*... best if he does that over a period of time (at a steadily increasing/worsening rate of "loss"), preferably a good year or two or more.
THEN he can finally get divorced -- having cleaned out savings/retirement funds, etc. (and again "LOST it all gambling") -- and then all that's left to "divide" (if anything) will be some trivial equity in the house, AFTER the sale.
* But instead have stored it away someplace and in some form that cannot be tracked.

talk to a lawyer, if you have a friend who is a lawyer, so much the better. don't do anything that would destroy your life like that. take legal actions, if you can wire the house for surveillance and actually catch her cheating on video, you will probably save an absolute ton on alimony, as well as YOUR house. be smart, this is going to effect the rest of your life and you did nothing wrong. good luck, brother.

Do not physically attack her. Do not act out of anger. Break the cycle of revenge by not going into it. This is not what you want to be known by.
If you feel that you do not want to be with her, you will need the help of a divorce lawyer and a private investigator.
If anything, gather the evidence and store it on your phone/computer. Keep it safe and take it to a divorce lawyer. Evidence is what you need. You also need to illustrate your point, like take a picture of your furniture where she took her picture to show she took this image within your house. The toilet seat example you can tell your lawyer, but I don't think that can really hold up as evidence. Save her Tinder profile and texts. Texts can be cross verified with a phone service provider.
I know this is hurtful, but recording her kissing or having sex with just one of the other guys will seal the deal in your favor. A private investigator might be the person you need here. Again, consult with divorce lawyer. Doesn't really matter if it is in your house or not, but that would extremely illustrate the point of her betrayal.
When your lawyer is set, have the lawyer present the divorce papers to your wife. Do not get into the arguments before this. There will be arguments, but after the lawyer has presented to your wife.
