If you have a custody order in place it's hard for a relocation to be granted. Needing a fresh start doesn't even come closes to meeting the threshold for relocation.

. She can not take the kids from where you are unless you agree. Judges keep kids in stable environments with least upset to kids.

Most all states default to 50/50 custody after the age of 3 for children iunless one parent wishes to have less time with the kids. Lots of men choose every other weekend because of work travel, new girlfriend, etc. but 50/50 in current schools and city is the norm

Make sure you have joint custody across the board i.e. joint physical, joint legal. I feel like my STBXW is trying this same move, she wanted sole physical, joint legal. Why? Because if she had sole physical custody she could technically claim to land a better job out of state and claim better living for the kids etc etc. so I made sure joint custody across the board. And just like the comment above- she cannot leave without my consent, the kids were born and raised where I was born and raised and will stay here until they decide to leave when they are older...

Definitely consult a lawyer right away, but in most cases, she would not be able to up and move without justification that you were dangerous. If she's dead set on it, its possible she could file a restraining order against you based on lies. Please seek counsel and get yourself represented. Its unfortunate but money well spent if this is whats on the line.
