Hasn't happened yet but the threat was given. I know that if one spouse leaves the marital home, then the court is more likely to give the remaining parent the primary rights and award support to.
But what happens when one spouse takes the kids out of the marital home prior to any separation agreement?
From my understanding, without the sep. agreeement, either spouse is allowed to take kids whenever. If I'm the one left in the marital home alone, does that play out the same as if I had left by myself?

im in the same situation, im the stay at home dad from day 1 she took the kids thursday and i have been pleading for there return. She wants to do this honestly she is putting this on our kids because of drugs yet she did them too. Frankly she is willing to even let lease of our apartment go bad
