Yes. Women do it all the time. Just read the news and look at the list of exonerees from prison sentences that should never had been served. And those are the select few cases of false accusations which are discovered when women are particularly bad liars or have a sudden change of heart.

But, lets go beyond that and examine why.

Rape is abhorrent. We were always raised and perhaps naturally believed it to be on par with murder. People become emotionally charged and we want to be able to discharge that emotion, and when a person is accused, we have our outlet. Even if it turns out later this person is just a scapegoat.

This person may or may not be the rapist. Or perhaps a rape never occurred. How do we know? By removing ourselves from the emotion and looking to the proof.

Does this happen? I have seen too many people released decades late to believe it does.

Whose fault is it? Ultimately, I believe, it is ours. Who declares rapists guilty, a judge? Unless they waived a right to a jury, we, the peers, equals in the jury do. So where does change need to happen? With us, the equals, the peers.

I am not saying everyone needs to go door-to-door asking if people have a moment to speak. If each of us just occasionally brings up the point with family, friends, or coworkers, we have done our part.

Challenge the status quo. When someone makes a remark that shows their dismissiveness of men, simply counter it with your belief. Make them think. It is fine to believe what you want to believe, but when challenged, you should rethink your position.

If each of us simply challenged 10 people's thoughts this upcoming year, perhaps we would change 1-2 of their minds. But then they can bring it up to others.

Lets be honest. You and I do not matter. You and I can do nothing, or very little. In a democratic society, change must come by majority decision, and we have a long way to go.

Of course. There are many high profile cases of exactly this.

The court agreed the accuser in the Duke lacrosse case lied and the prosecutor was punished for assisting her.

She walked away scot free.

There are a couple things I think need to be brought up, especially with all of the high-profile accusations coming out now.

First of all, there is the is issue of time. Most if not all of the accusations are about acts that supposedly we committed a long while ago, some even 20 or 30 years ago. The result of this is that there will most likely be a complete lack of evidence that supports the accuser, which leads to the second issue.

The second issue is proof, and whether or not men are viewed as “guilty until proven innocent”. As far as the legal system is concerned, technically, everyone accused of a crime is innocent until proven guilty. This is a very important safeguard that we have in this country, but one thing it doesn’t protect from, as far as I know, is action from an employer against the accused. If an employer wants to fire an employee who is accused of sexual misconduct, there is nothing stopping them. At that point the only option for someone who is falsely accused would be for the, now unemployed, person to hire a lawyer who could not only make sure the accuser is convicted, but also sue the false accuser for defamation and hope that they can win enough in the lawsuit to make up for lost wages.

They're not generally assumed guilty to a criminal standard. However, to compensate, the system has been set up so that the process is the punishment itself by ensuring the accused is not protected by anonymity unlike the accuser.

Yes most rape and sexual harassment claims are fake and very rarely do the false accusers get any punishment.

Yes. You need to prove beyond a reasonable doubt that they actively and intentionally lied to hold them accountable.

Is it true that men are considered guilty until proven otherwise?

Not before the law, but generally within the public's eyes.

You can sort by falsely accused. A lot of those exonerations are sexual in nature, and these are just the cases where people have been exonerated. No doubt, there are quite a few men rotting in prison that have no hope of having their trial over turned.

There are firms out there specializing in Title IX cases where men have been destroyed by college campuses. Perhaps some of those cases are legit, but college campuses have been trampling over the ability for the accused to defend themselves.

Some laws do in fact drop the presumption of innocence for men in Canada (especially) and the US and EU. Mostly though it's just prejudiced thinking. Cops are trained to figure the man is always the guilty one, HR departments will see the man as the "problem" even when it's the woman making a fuss.

But I'm not sure the USA is any worse than many other countries.
