That's right. Preach it. I'm actually quite pissed that it was called "rape" in an unequivocal sense throughout the article and with the charge being first degree felony. They didn't even claim it to be "corruption of minor" or any other charge that would mean "statutory rape". They called it, without any doubt, "rape". That's fucked up.

The fact that they claimed that "16 and 17 year olds can choose this" means that the supposed victim CHOSE to have sex, ergo it wasn't actually rape, even though she was initially charged with that.

People are sure being liberal about "close in age" these days... kind of stupid. Even if the person was 50, if the 16 or 17 year old chose it I would disapprove if they classed it as first degree felony rape. In any state where age of consent is 16, a non-teacher who was 50 years old could fuck said 16 year old.

The probable cause statement reports Sarah Lewis, a former teacher at Landmark High School in Spanish Fork, admitted to having sexual intercourse with the male student in her Payson home.

According to court documents on June 25, 2017 Mr. Means came across an amended statute in Utah Code that states, "If a minor is 16 or 17 years old, the rape charge can be reduced to Unlawful Sexual Conduct, when applied to a person who holds a relationship of special trust: such as an adult teacher, employee, or volunteer."
