I wasn't one of the people that gave you a hard time, but if there are no more details that materially change this case that aren't in the article, I would agree with you. This person deserves more time.

I don't have a good answer for this one. On the one hand jail is a shitty idea that is bad for everyone and this guy needs treatment, but also it was a fucked up thing to do.

Probably a better answer with both. X amount of years, if y amount of years are served with good time, then can be transferred for rehabilitation and earlier release than if not rehabilitated.

You need to have jail time to serve as a deterrent to the next criminals, also the victim needs to feel that at least some justice was served. Further, it would be in the best interest of society if he can be rehabilitated before release as to not do it again.

Unverifiable claim. If she could no longer recognize him, how did he get caught?

He said she had repeatedly resisted his sexual advances. The age of consent in California is 18.

In the end, he confessed that she was not consenting (although she did take her clothes off for an apparent 'stranger') and she isn't legally capable by age of consent law, as well as it being his FUCKING SISTER, so he should probably get a few more years than he did, but the ineligibility for parole makes it a hard decision.

I believe that when you talk about 'shouldn't be seeking more jailtime' it usually comes around the age of consent violations where an underage teen repeatedly meets up with an older woman for sex without obvious coercion involved.

This has obvious coercion. It can't really be compared as 'equality'.

Now, if he'd been 20 with a willing high school aged girlfriend and got done in by the law, this would definitely be 'equality'.

I'll have to look into dabs, I've known a lot of pot smokers and no matter how potent the pot they have never been so fucked up as to not recognized their own sister.

But I've never heard of Dabs, so maybe it's different I don't know.

If Dabs can do what has been suggested, then yes the sentence was on the low side.

For the record in the cases were female (or male) teachers has consentual sex with students 16+ I don't support prison sentences at all.

Normally I'd be on the "if you consented to take drugs, then consented to doing something stupid while you were high, it's still consent" side of things, but the girl being 16 and the brother being in a "position of power" complicates things.

An adult coercing a child into taking drugs and having sex is...well, an adult coercing a child into having sex; which is illegal. But there's some gray area around a 16 year old being considered a child or an adult.

I'll yield to the jury's decision on this one.

The exception that proves the rule. Why would this in particular upset you or draw you attention? Women routinely get lenient sentences so a lenient sentence to a woman is not strange.

Neither I wanted to see how people felt about a man getting a lenient sentence since everyone disagreed with me for arguing that instead of women getting harsher sentences, men should get more lenient sentences.
