The law is supposed to apply to the "primary caregiver".

In practice if a family shows up, the government declares the mother the primary caregiver. There are no custody hearings or determinations of which I'm aware, and detention for families always includes mom and the kids.

Also, there is a pattern or practice of anti-father discrimination in child welfare proceedings anyway, meaning if a dad shows up with kids and no mom the kids are much more likely to be sent into fostercare.

I've never actually seen a news article citing a single instance of fathers and their children in immigration detention. AFAIK, it just doesn't happen. Fathers are effectively treated as lesser parents.

Can they? I doubt it honestly. Once a child is "in the system" the government will assert the best interests doctrine and keep them there, especially if they're otherwise headed back to a life of poverty in a third world country.

This is a necessary policy. People use the compassion of our court system (not wanting to incarcerate children) to get themselves across our border, out of our detention facilities, and enmeshed in our society. By the time the court case on thrir immigration status roles around, presto, they are the proud parents of a new American citizen! Every adult involved in deportation proceding should be held in custody awaiting trial. The way we've been handling this is insane.

Truly desperate parents, who believe that their child is safer in American foster care than in their country of origin, will still try to cross. Economic migrants won't - or if they do, they'll leave the kids at home with extended family or make sure that they have a relative in the U.S. who is willing and able to take custody of them.

Male refugees are generally at a higher risk of being separated from their kids. Male economic migrants generally cross without their families or do not have families yet.

Women and children crossing together illegally into the United States could be separated by US authorities under a proposal being considered by the Department of Homeland Security, according to three government officials.

A third DHS official said the department was actively considering separating women from their children but has not made a decision.

The policy would allow DHS to detain parents while complying with a ninth US circuit court of appeals order from July 2016 that immigrant children should be released from detention as quickly as possible.
