No, I don't see anything wrong here.

Neither a doctor, a college professor, nor a lawyer are typically acting in a custodial fashion towards a young person 16 - 17 years old.

For example, if a doctor were in charge of a youth home or group living facility or mental facility, where the children were in the custody of the doctor, then I wouldn't have any problem with the physician being charged with a crime for having sex with 16 or 17 year old minor in his charge. Probably the law does cover that in most states, with respect to group living facilities and minors.

That's not the typical situation a doctor or lawyer is in. A typical doctor sees a patient for all of 15 or 20 minutes in an outpatient visit, and parents are not typically charging the doctor with oversight / babysitting responsibilities. The doctor is more along the lines of the grocer or the bartender than the teacher.

Not that I would have a problem with a doctor being charged criminally for having sex with a 16 or 17 year-old person who was his patient. Probably should happen.
