Legally you need CONSENT, it doesn't require her to say "yes" (other than college which is retarded).

The biggest isn't isn't literal consent (theoretically that's always your word against hers), it's about making it so the girl doesn't make any false claims against you. For the sane ones, it needs to be clear in HER head that she wanted it, and teasing her is the best way to get that. I work it into the foreplay. Once things start getting handsy, I'll put their hand on my cock and if the reaction is right, I'll say "mmm you want that don't you" and 9/10 times they'll moan yes or start trying to pull it out. Once it progresses to actual sexy time, I'll repeat the question and usually make them beg a little to fuck them before I actually do. This solves the consent problem and increases immersion for a better experience.

This combined with always having my phone recording during the first couple of sexual encounters (always audio, but usually video depending on logistics of her place vs mine) means I'm pretty protected if an allegation occurs.

Anyone can accuse you of rape at any time for any reason.

There is no relationship between having sex with a girl and being accused of rape, and there is certainly no relationship between not getting verbal consent and being accused of rape. There literally is just no correlation.

All consent is implied consent, except actual written contracts or maybe AV recordings.

So just don't worry about it.
