The prosecutor handled the case exactly like I'd want every single prosecutor to handle rape accusations. She went into it completely unbiased. Decided that, based on 30 seconds of video, it could have been rape. As soon as more evidence came to light, she realized that this was not rape, dropped the charges against the two men and instead filed charges against the woman.

The prosecutor let evidence guide her decision-making, not blind belief in either side of the story.

Funny how even a moderator here saw the case in the wrong light, after the feminist MSM spread their bullshit. (Not trying to put fuel in the fire again, just pointing out, how effective their propaganda is).

As I wrote at the first article that was linked here, the chance for a public prosecutor to prosecute a false rape allegation in Germany without absolutely waterproof evidence is close to zero. (As in most countries).

And if she is stupid enough to challenge the courts decisison, she will lose again. I hope she does, just costs her more money. ;)

If she is somewhat smart, she will stop now, pay the fine, and publish a book about the evil that was done to her. Get prepared to see her and her slimy lawyers in every show on TV to push the feminist agenda of "unpunished rape" further.

Actually the judge gave her 20 days(*) more than the prosectur originally filed for.

(*) money fines in Germany are calculated on the daily income of the fined person. So a poor guy and a billionaire both get the same amount of "days" for a crime, but the rate is much higher for the billionaire.

edit: And another point: That c*** can be happy, that she lives in a gynocentric society, where she just has to pay a few Euros instead of being thrown into jail for 5-10 years, which would be the fair sentence.

Making false rape accusations, or false accusations of any type, is nothing short of trying to ruin a person's life. A fine is a slap on the wrist for something so serious. There should be jail time.

The idea of not prosecuting false allegations because it deterred true complaints was always dodgy.

It was assumed was that false accusations are very rare, but they are not.
At the very least a few percent of complaints are consciously false. After reading a bunch of modern studies I guess 5-10% are false. (Many of those are not malicious e.g. misunderstanding the law). There are older studies which give much higher numbers but I'm inclined to believe experts have increased understanding about rape over the years, not lost it.

Another reason for not prosecuting false complaints was that it gives them publicity which will lead to copycat false accusations. This is obviously true, but it is balanced to some extent by people deterred by seeing false accusers punished.

The question is what the balance will be between copycats and people deterred by prosecutions and convictions. That depends a lot on what proportion of prosecutions for false allegation result in a conviction, and what the penalties are.
For that reason it would be counter-productive to prosecute for false allegation unless there is both a very strong case, and an expectation of a substantial penalty.

The police do receive such cases, and it is time they were prosecuted.
