It's not new feminist law.

It's a legal extension of the same principle that underpins marital rape legislation, which is that prior consent can be revoked at any time, and that there's no status or context, even a marriage bed, that is an automatic, ongoing grant of consent.

She was incoherent and passed out on the grass. Come on, man, let's not get in the business of defending people that take advantage of that situation by hanging their hat on consent prior to all that drinking.

CivilSaint prompted me to look more closely at the victim's words.
She was recapitulating Turner's argument that she consented; she was not admitting consent. She simply denied memory of consenting.
But then, this remains an oath-on-oath case - his claiming that she consented before incapacitation, her claiming she doesn't remember. That's a thin basis for conviction.

This may be off topic, but is my view of the case.

Option 1: A woman wakes up in hospital at 4:15 in the morning. The nurse says you drank too much and passed out, and tells her to go back to sleep. She wakes up later in the morning. A policeman asks her if there is anything to report, she says she cannot think of anything. No victims that day.

Option 2: Woman wakes up at 4:15, a policeman tells her she has been raped. She undergoes several hours of being prodded and probed in every hole. She is told she may get AIDS from an HIV rapist and has an injection. Intimate pictures are taken of her naked body leaving her feeling violated/brutalised (Raped?). A man gets charged with her rape. At no point does she say, "That man raped me". Several months later the rape charges are dropped by the corrupt court system, but he is found guilty of indecent assault. TWO VICTIMS.

A year after the incident, the woman still cannot remember anything of the alleged incident, but she remembers the horrible hospital ordeal.

Is this justice? Is it sensible? Did the authorities want a case to get their teeth into, a scapegoat?

All we know for certain is he was found having sex with her unconscious by two Swedes, that's the only solid thing, behind a Dumpster.

Still what no feminist will admit that this is more evidence that getting that fucking drunk is for MORONS!

Seriously, a few more drunks for him, a couple fewer for her, and it could have been her riding his unconscious form that the Swedes found.

So is it rape? Yep.

Does he deserve to go to jail for more then 6 months, yes it was pretty fucked up.

Could have been that lady going to jail if he'd past out instead, and she had ridden him? No she's a woman, so she'd most likely have enjoyed a pussy pass. But in a fair system she'd end up with the same sentance.

So at the end of the day, she's totally tramatized, even at 6 months in jail his life is ruined, he'll never go to the Olypmics, he'll have rapist on his reputation forever, and anytime in jail can be brutal.

So they're both just scarred or while be soon enough after that dude does prison.

And yet if I point out that if either of them had not gotten so fucking drunk that one past oit and the other acted like a retard, none of this would have happen, and they'd both be just living their lives instead of two ruined lives.

I can point out that if either of these Morons had been driving drunk like that, someone could have DIED.

I have a rule for not being a rapist for Sarah Silvermen, don't be a fucking drunk or junkie. Seriously outside of pyschopaths and pediphiles, men know not to rape women, but drunk, they might not even know their names.

I don't get the appeal of getting that drunk. From what hear even the consentual sex isn't that good while that drunk. I just don't get it.

Where is the evidence she had passed out when the incident occurred?

Sounds like a typical case of a woman waking up the next morning after drunken sex, unable to remember anything, then goes on a rape crying spree.
